- ДокументCriminology and Ontological Trends of the Russian- Ukrainian War in the Context of Globalization Processes: Human Rights Protection and Law Enforcement Concepts(Novum Jus, 2023) Sokurenko, VitaliiWar is inevitable and its consequences devastating. When war is persistent, becomes criminal, and affects society in many ways, like in the loss of human lives, violating the fundamental human right to life. This article examines related issues in the Russian-Ukrainian war from a criminological point of view in the context of the modern threats from the globalization processes and a total change (reconstruction) of the situation in the world. The objective of the law is to ensure that laws related to war should be enforced and respected by everyone engaged in it, be the military or other persons. Special attention is paid to law enforcement and human rights protection, as well as to the implementation of power-management relations based on professionalism and high moral foundations, based on the best traditions of the spirituality of the Ukrainian people. An interdisciplinary method of scientific research was applied to examine the relationship between military criminology and criminotheology and the need to involve clergymen, chaplains in raising morale and daily prayers for the personnel and the people in general. Hence, the character of the criminal (psychological portrait) can be significantly transformed by combining science and religion. It is extremely important to confront internal and external threats in the defense of national interests.

This has led to rethinking of human values, crystallization of attitudes towards death, in particular, whether we are ready to “lay down our lives for our friends” (John 15:13), and thus to exercise the highest expression of love for our neighbour. Our grandfathers and great-grandfathers, who survived famine and other shocks, were most afraid of war. The main wish after 1945 was a peaceful sky on the Earth. What spiritual power and strength was laid in the words of peace? However, seventy years of freedom gradually contributed to the loss of this feeling. The human heart has become petrified, and people have become cruel and hateful to each other, when for certain reasons global circumstances condone war. No one could have thought that our northern neighbor would destroy cities and villages, critical infrastructure of our country, with such force and pace. History and time will give answers to all the questions and condemn the criminals.

The main purpose of the article is to analyse current legal and economic issues of national security governance in Ukraine at war. The subject of the study is the importance of national security governance in defining national values and interests and in assessing damage in Ukraine. The methodology of the research includes the method of descriptive and explanatory study of legal issues of national security governance in Ukraine. The study is based on an analysis of legal documents and academic articles. For the purposes of the paper, the analysis of the literature on the subject and the method of document research were used. Originally, the regulations regulating the legal issues of national security governance in Ukraine were included in the Law of Ukraine "On National Security". The paper modifies the current situation regarding the normative provisions that should be updated. The hypothesis of the paper is that the concept of objective values is constantly evolving and that there is no unified approach to its definition. The practical implications are as follows: the number of refugees from Ukraine is still growing, so Ukraine should pursue its national interests in the receiving countries in order to protect universal values. As a result, during martial law Ukraine civil society set up objective values within its national interests, locking up counter-terrorism and human trafficking. The value/originality of the paper is that it expands the knowledge about the interconnection of objective values and national interests of the state with a special focus on Ukraine at war.

We believe that if we can talk about the criminology of war, then the criminology of peace should also be studied. Perhaps it is in the key of "war and peace" that certain aspects of criminotheology should be developed. In writing, an interdisciplinary method of research was used, due to which it was possible to highlight the most diverse aspects of the problem under study, namely, historical, psychological, economic, political, economic, and military sciences, which will give many useful results. At the same time, it should be noted that the military sphere is not the subject of special research by criminologists. Therefore, from the standpoint of the current Russian-Ukrainian war, such an initiative is extremely important. Raising the morale of the army through the writing of monographs and basic research is currently very important in terms of the historical past, studying foreign best experience, and modern warfare practices. Also, the scientometric cross section will help to carry out a comprehensive analysis of knowledge in various fields of human knowledge in relation to the outlined area of research; secondly, in this way, it is possible to formulate the ideology, criminological and criminal law policy (doctrine) of the state in terms of building new meanings of these blocks of research, depending on the circumstances and factors of the need to criminalize and decriminalize socially illegal acts. The military sphere needs constant updating, which is now increasingly observed in scientific journals and news columns. The importance of practice in the life of each person is evidenced by the Japanese principle that "one cannot hold the position of Minister of Communications without being a postman and without passing through all levels of the power hierarchy". Perhaps we should see the war, just as Lina Kostenko often went to Chernobyl to be alone and write immortal poetry. No exterior, a criminologia da guerra é um dos temas mais promissores e relevantes para a pesquisa científica. Acreditamos que se podemos falar sobre a criminologia da guerra, então a criminologia da paz também deve ser estudada. Talvez seja na chave da "guerra e paz" que certos aspectos da criminoteologia devam ser desenvolvidos. Na escrita, foi utilizado um método interdisciplinar de pesquisa, pelo qual foi possível evidenciar os mais diversos aspectos do problema em estudo, nomeadamente, ciências históricas, psicológicas, económicas, políticas, económicas e militares, que darão muitas contribuições úteis resultados. Ao mesmo tempo, deve-se notar que a esfera militar não é objeto de pesquisa especial por criminologistas. Portanto, do ponto de vista da atual guerra russo-ucraniana, tal iniciativa é extremamente importante. Elevar o moral do exército por meio da redação de monografias e pesquisas básicas é atualmente muito importante em termos do passado histórico, estudando as melhores experiências estrangeiras e as práticas modernas de guerra. Além disso, o corte cientométrico ajudará a realizar uma análise abrangente do conhecimento em vários campos do conhecimento humano em relação à área de pesquisa delineada; em segundo lugar, dessa forma, é possível formular a política ideológica, criminológica e penal (doutrina) do Estado no sentido de construir novos significados desses blocos de pesquisa, dependendo das circunstâncias e fatores da necessidade de criminalizar e descriminalizar atos socialmente ilegais. A esfera militar necessita de uma atualização constante, que agora é cada vez mais observada em revistas científicas e colunas de notícias. A importância da prática na vida de cada pessoa é evidenciada pelo princípio japonês de que "não se pode ocupar o cargo de Ministro das Comunicações sem ser carteiro e sem passar por todos os níveis da hierarquia de poder". Talvez devêssemos ver a guerra, assim como Lina Kostenko costumava ir a Chernobyl para ficar sozinha e escrever poesia imortal.

It examines war through a criminological lens, aiming to understand its short and long-term effects on society. Through empirical analysis of Ukraine's management of the crisis, the study evaluates how the socio-cultural perspective influences war handling. Destructive consequences such as increased stress levels and migration, alongside constructive factors, are identified. The research highlights the criminogenic potential of war trauma and post war syndrome. Despite various methods and hypotheses, socio-cultural effects persist, posing a complex challenge for Ukraine. War is portrayed as a multifaceted phenomenon influenced by demographic, economic, and ideological factors, as well as historical legacies. Ultimately, the conclusion underscores the irreparable impact of war on the environment, populations, and international relations. This suggests a pressing need for comprehensive efforts to mitigate the long-term consequences of war and foster stable post-conflict societies.
- ДокументЗЛОЧИНИ РАДЯНСЬКОГО ТОТАЛІТАРНОГО РЕЖИМУ ПРОТИ УКРАЇНСЬКОГО НАЦІОНАЛЬНО-ВИЗВОЛЬНОГО РУХУ В 1944 РОЦІ У СВІТЛІ ВОЄННОЇ КРИМІНОЛОГІЇ(Одеса: ОДУВС, 2022) Сокуренко, Віталій Валерійович; Sokurenko, VitaliiЗ перших днів створення УПА її діяльність мала не регіональний, а всеукраїнський характер, що рельєфно видно з політичної програми боротьби за відновлення соборної, незалежної України. Правовими підставами визнання заслуг перед Україною ОУН та УПА є відповід- ність їхньої діяльності загальновизнаним принципам і нормам міжнародного права і сучасному законодав- ству України, які схвалюють національно-визволь- ний рух народів за свободу і незалежність, а також визнають невід’ємне право націй на самовизначення й утворення власних національних держав. Радянська влада усіма силами намагалася завадити діяльності УПА, знищити її учасників, позбавити український національно-визвольний рух його військового крила. З цією метою використовувалися військові операції із залученням танків, бронепотягів, артилерії та літа- ків, депортації населення Західної України в Сибір. Широко застосовувалися провокації, коли спецзагони НКВС під маркою УПА намагалися захопити в полон провідників УПА, рядових вояків, дезорієнтувати їх, отримати інформацію про їхню діяльність, склад та плани. При цьому здійснювалися воєнні злочини, які були безпосередньо пов’язані з оперативними діями військ стосовно населення району воєнних дій і порушували міжнародні конвенції. Це призводило до масового і серйозного порушення норм міжнародного гуманітарного права, посягань на життя населення регіону, де відбувалися бойові дії, їхні основні права та найважливіші принципи міжнародного гумані- тарного права. Безпосередньо придушенням націо- нально-визвольного руху в Західній Україні керували перші секретарі обкомів компартії. Для цих людей характерними були відсутність співчуття, почуття провини, сорому, а також наявність жорстокості. Ці якості у них виробило життя та діяльність в умо- вах радянської тоталітарної системи, де й форму- валася їхня особистість. Ними керувала також вихо- вана роками комуністичної пропаганди ненависть до всього, що не є радянським, несприйняття та неро- зуміння психології українців. Основною мотивацією їхньої злочинної поведінки було прагнення нав’язати чужий українському менталітету політичний режим, утвердити все за допомогою насильства аж до масо- вих убивств, а також збудувати власну кар’єру будь- якою ціною. Географія вказаних злочинів представ- лена, в основному, територією Західної України, де відбувалося основне протистояння між УПА та радян- ською владою. Головним було те, що весь радянський тоталітарний режим був злочинним по своїй суті, а тодішні керівники республіки та областей були його «гвинтиками», тому їхня політика фактично апріорі була злочинною, і наведені у статті факти повністю підтверджують це. From the first days of the creation of the UIA, its activities were not regional, but all-Ukrainian in nature, which is clearly visible from the political program of the struggle for the restoration of the cathedral, independent Ukraine. The legal grounds for recognizing the merits of the OUN and UIA to Ukraine are the compliance of their activities with the generally recognized principles and norms of international law and modern legislation of Ukraine, which approve the national liberation movement of peoples for freedom and independence, and also recognize the inalienable right of nations to selfdetermination and the formation of their own national of states. The Soviet authorities tried with all their might to hinder the activities of the UIA, to destroy its members, and to deprive the Ukrainian national liberation movement of its military wing. For this purpose, military operations involving tanks, armored trains, artillery and airplanes, and deportation of the population of Western Ukraine to Siberia were used. Provocations were widely used, when special forces of the PCIA under the UIA brand tried to capture UIA leaders, ordinary soldiers, disorient them, and obtain information about their activities, composition and plans. At the same time, war crimes were committed, which were directly related to the operational actions of the troops in relation to the population of the area of hostilities and violated international conventions. This led to a massive and serious violation of the norms of international humanitarian law, encroachments on the lives of the population of the region where hostilities took place, their basic rights and the most important principles of international humanitarian law. The suppression of the national liberation movement in Western Ukraine was directly managed by the first secretaries of the regional committees of the Communist Party. These people were characterized by a lack of compassion, a sense of guilt, shame, as well as the presence of cruelty. These qualities were developed by life and activity in the conditions of the Soviet totalitarian system, where their personality was formed. They were also guided by the hatred for everything that is not Soviet, brought up by the years of communist propaganda, the lack of acceptance and misunderstanding of the psychology of Ukrainians. The main motivation of their criminal behavior was the desire to impose a political regime foreign to the Ukrainian mentality, to establish everything with the help of violence up to mass murders, as well as to build their own career at any cost. The geography of these crimes is mainly represented by the territory of Western Ukraine, where the main confrontation between the UIA and the Soviet authorities took place. The main thing was that the entire Soviet totalitarian regime was criminal in its essence, and the then leaders of the republic and regions were its "screws", so their policy was actually a priori criminal, and the facts presented in the article fully confirm this.

Це можна досягти шляхом проведення систематичних короткострокових тренінгів для співробітників по виявленню підробних документів. Ми вважаємо що такий підхід значно ускладнить можливості використання підробних документів як для криміногенного світу так і для ворога. The author believes that in order to increase the capacity of the law enforcement system to detect forged documents, the level of qualification of the persons who check them should be increased, both in the system of the National Police and in the system of the Ministry of Internal Affairs and other law enforcement agencies. This can be achieved by conducting systematic short-term training for employees on the detection of forged documents. We believe that such an approach will greatly complicate the possibility of using forged documents both for the criminal world and for the enemy.

Також, зокрема, необхідно здійснювати моніторинг осіб, які безпосередньо причетні до порушень прав людини у Криму, зокрема тих, які невиправдано дають розпорядження про те, щоб викорінювати українську або кримськотатарську мови з навчання, а також осіб, які невиправдано перешкоджають кримським школярам їхати на материкову частину України та вступати до українських університетів. Інформаційна політика щодо деокупації Криму має спрямовуватися на молоде покоління з використанням інтернет платформ та соціальних мереж. Успішність політики деокупації Криму залежить від злагоджених дій держави, органів виконавчої влади на місцях та місцевого самоврядування, інститутів громадянського суспільства за підтримки світової спільноти. The prospect of the deoccupation of Crimea shows that it is necessary to start training personnel for Crimea now: law enforcement agencies, justice workers, educators and other civil servants. Also, in particular, it is necessary to monitor persons who are directly involved in human rights violations in Crimea, in particular those who unjustifiably give orders to eradicate the Ukrainian or Crimean Tatar languages from education, as well as persons who unjustifiably prevent Crimean schoolchildren from going to the mainland part of Ukraine and enter Ukrainian universities. The information policy regarding the de-occupation of Crimea should be aimed at the younger generation using internet platforms and social networks. The success of the policy of deoccupation of Crimea depends on the coordinated actions of the state, local executive authorities and local self-government, civil society institutions with the support of the world community.
