Interpretation of Article 45 of the Criminal Procedure Code of Ukraine in terms of limiting the constitutional right to choose a defense lawyer has been analyzed. A comparative analysis of current and European legislation in the sphere of access to legal aid is presented. Decisions of the ECtHR in the cases “Brusco v. France”, “Talat Tanci v. Turkey”, “Katz and others v. Ukraine” have been researched. The main issues related to participation of the defense party in criminal proceedings are highlighted. It has been theoretically established that an efficient implementation of the right to defense in criminal proceedings requires the application of the ECtHR practice, which serves as an additional effective mechanism for effective defense of human rights and representation of human interests in criminal proceedings. Метою дослідження є розкриття кримінально-процесуального захисту (захисту) прав людини в умовах збройного конфлікту. Тлумачення статті 45 Кримінального процесуального кодексу України з точки зору обмеження. Проаналізовано тлумачення статті 45 Кримінального процесуального кодексу України з точки зору обмеження конституційного права на вибір захисника. Проведено порівняльний аналіз чинного та європейського законодавства у сфері доступу до правової допомоги представлено порівняльний аналіз чинного та європейського законодавства у сфері доступу до правової допомоги. Проаналізовано рішення ЄСПЛ у справах «Бруско проти Франції», «Талат Танчі проти Туреччини», «Кац та інші проти України». Визначено основні питання, пов'язані з участю сторони захисту у кримінальному провадженні висвітлено основні питання, пов'язані з участю сторони захисту у кримінальному провадженні. Теоретично встановлено, що ефективна реалізація права на захист у кримінальному провадженні права на захист у кримінальному провадженні потребує застосування практики ЄСПЛ, яка слугує додатковим дієвим механізмом ефективного захисту прав людини та представництва її інтересів у кримінальному провадженні.
- ДокументPROCEDURAL COSTS IN CRIMINAL PROCEEDINGS INITIATED IN CONNECTION WITH CRIMINAL OFFENCES COMMITTED BY MINORS: THE IMPACT OF REASONABLE ALLOCATION ON THE ECONOMIC SYSTEM OF THE COUNTRY(Baltic Journal of Economic Studies, 2023) Voloshanivska, Tetiana; Волошанівська, Тетяна Володимирівна; Yepryntsev, Pylyp; Hanenko, IhorThe purpose of the article is to reveal the essence and content of procedural costs in criminal proceedings initiated upon the fact of criminal offences committed by minors; to define the concept, essence and content of procedural costs in the current criminal procedural legislation of Ukraine; to study the problems of criminal proceedings and judicial proceedings in relation to minors; to consider the principle of procedural economy in criminal proceedings. A scientific discussion of the problem of unification of the provisions of the criminal and criminal procedural legislation of Ukraine with a view to ensuring a full pre-trial investigation, trial proceedings and determination of appropriate types of punishment for minor offenders has been presented. The concept of procedural costs in criminal proceedings in Ukraine was improved and methods of their implementation through the provisions of the national criminal procedural legislation were determined. The authors' understanding of the main distinguishing features of procedural costs is presented. The practice and legal positions of the Supreme Court regarding the limits and methods of covering the costs of proceedings have been considered. It has been established that the principle of procedural economy in the criminal justice system has been implemented by ensuring the smooth functioning of all court instances and the up-to-date comprehensive normalisation of investigative situations that may arise in the pre-trial investigation process and the selection of full investigative (research) and covert investigative (research) actions, with the aim of avoiding cases of repeated procedural measures to ensure the proper course of evidence. Results. It has been established that the procedural expenses in the criminal proceedings of Ukraine should be understood as the material damage provided by the criminal procedural legislation of Ukraine, caused by ensuring the needs of the pre-trial investigation and court proceedings, in particular, related to the process of evidence and realisation of rights, freedoms and legitimate interests of the parties and other participants in the criminal proceedings. The essence and meaning of the procedural costs are realised through the prism of the provisions of the Criminal Procedure Code of Ukraine (in particular, Article 124, which regulates the peculiarities of the distribution of the procedural costs), which ensure the protection of the state and the persons who have been the victims of a criminal offence from possible material losses that may arise in the course of conducting pre-trial investigation and trial. The main distinguishing feature inherent in the content of procedural costs is the form in which the decision to recover them is made – a court verdict or a court ruling. It has been proved that in modern conditions, in the context of criminal proceedings against minors, the following issues remain to be solved as a matter of urgency 1) improvement of the norms of criminal procedural legislation in the part of criminal proceedings against minors under the conditions of the special legal regime of martial law; 2) improvement of the personnel provision of the judicial system with regard to the selection of candidates for the position of a judge who conducts judicial review of cases of minors; 3) improvement of the procedure for carrying out investigative (search) actions in criminal proceedings initiated due to the fact of commission of a criminal offence by minors; 4) establishment of international cooperation in the pre-trial investigation of transnational criminal offences committed in complicity with minors. It was concluded that, in order to maintain the economic cycle, it is necessary to ensure a balance between the procedural costs within the framework of criminal proceedings and court costs for legal proceedings and the funds that go to the state budget. This includes, in particular, the establishment of a mechanism for compensating persons who have committed criminal offences and the normalisation of types of punishment with an emphasis on material punishment. Special attention should also be paid to improving the work of the courts of first instance in order to avoid cases being reviewed in the courts of appeal and cassation.

It examines war through a criminological lens, aiming to understand its short and long-term effects on society. Through empirical analysis of Ukraine's management of the crisis, the study evaluates how the socio-cultural perspective influences war handling. Destructive consequences such as increased stress levels and migration, alongside constructive factors, are identified. The research highlights the criminogenic potential of war trauma and post war syndrome. Despite various methods and hypotheses, socio-cultural effects persist, posing a complex challenge for Ukraine. War is portrayed as a multifaceted phenomenon influenced by demographic, economic, and ideological factors, as well as historical legacies. Ultimately, the conclusion underscores the irreparable impact of war on the environment, populations, and international relations. This suggests a pressing need for comprehensive efforts to mitigate the long-term consequences of war and foster stable post-conflict societies.
- ДокументWAR CRIMES UNDER MARTIAL LAW IN UKRAINE: CURRENT CHALLENGE(Norwegian University of Life Sciences, 2024) Ганенко, Ігор Сергійович; Hanenko, IhorThe martial law imposed in Ukraine has become a litmus test for a record increase in military crime, and as a result, against the background of a general decrease in crime in the State, the commission of military criminal offenses has rapidly increased. In 2023, the total number of criminal offenses committed amounted to 475,595, which is a quarter (24.8%) higher than last year. Of these, 28,666 were military criminal offenses, which is more than 2 times higher than last year's figures for this type of crime in the country. The main negative factors that make up the system of determinants of military criminal offenses in Ukraine, and especially under martial law, include constant expectation of a threat to life and health; high risk of death or injury; real possibility of being taken prisoner, taken hostage with further torture and abuse; direct vision of the death of colleagues, close friends, civilians; growing fear of being killed or wounded when the rotation period approaches; uncertainty about favorable developments influenced by military leadership and the level of discipline in the military unit; a sense of uncertainty due to a lack of personally relevant information; disruption and/or change in diet, rest and sleep, water and food quality, exposure to unusual or unfavorable climatic and geographical factors that generate feelings of uncertainty and anxiety; isolation of servicemen and their forced loneliness during prolonged stay at combat posts while guarding areas, roads, and districts in unclear conditions, with unstable communication, without constant close contact with the main groups; distance from loved ones and anxiety about them. In the context of studying the general social prevention of military criminal offenses under martial law in Ukraine, the author proves that the formation of patriotism of servicemen of the Armed Forces of Ukraine and other military formations is impossible without ensuring an appropriate set of state and social measures aimed at the consciousness and behavior of the personality of a future serviceman, aimed at developing high civil, socio-psychological, moral, physical, military professional and volitional qualities aimed at ensuring both the constitutional duty of Ukrainian citizens to protect the Motherland and the proper performance of combat missions in any conditions. Within the framework of special criminological prevention of military criminal offenses under martial law in Ukraine, the author substantiates and proves the need to establish mental health departments at the level of divisions and brigades, which should be headed by psychiatrists and include mental health officers (licensed psychologists and/or social workers with specialized education who have at least one year of experience in relevant medical institutions). The author establishes that the main purpose of individualized preventive measures to prevent the commission of military criminal offenses in Ukraine is a positive correction of a serviceman's personality aimed at changing his behavior from anti-social to law-abiding. The analysis of court verdicts has confirmed that criminal punishment for committing military criminal offenses as the main means of combating deviations in the lawful behavior of servicemen does not prove to be effective. Введений в Україні воєнний стан став лакмусовим папірцем до рекордного зростання військової злочинності, в результаті чого на тлі загального зменшення злочинності в державі набуло стрімкого зростання вчинення військових кримінальних правопорушень. У 2023 році загальна кількість вчинених кримінальних правопорушень склала 475 595, що на чверть (24,8%) перевищило показники минулого року. З них 28 666 склали військові кримінальні правопорушення, що більше ніж в 2 рази перевищило минулорічні показники досліджуваного роду злочинності в державі. До основних негативних чинників, що складають систему детермінант вчинення військових кримінальних правопорушень в Україні, а особливо в умовах воєнного стану слід віднести: постійне очікування загрози життю і здоров’ю; високий ризик смерті чи каліцтва; реальна можливість потрапити у полон, у заручники з подальшими тортурами і знущаннями; безпосереднє бачення загибелі товаришів по службі, близьких друзів, мирного населення; зростання у деяких військовослужбовців страху бути вбитим або пораненим при наближенні терміну ротації; невпевненість у сприятливому розвитку подій, вплив на які має військове керівництво та рівень дисципліни у військовому підрозділі; відчуття невизначеності внаслідок дефіциту особисто значущої інформації; порушення та/або зміна режиму харчування, відпочинку та сну, якості води та їжі, вплив незвичайних або несприятливих кліматично географічних чинників, що породжують почуття невпевненості і тривоги; ізоляція військовослужбовців та їх вимушена самотність під час тривалого перебування на бойових постах при охороні ділянок, доріг, районів у незрозумілих умовах, з нестійким зв’язком, без постійного тісного зв’язку із основними угруповуваннями; віддаленість від близьких, та тривога за них. Аналіз заходів запобігання військовим кримінальним правопорушенням в умовах воєнного стану в Україні надав змогу виділити та докладно охарактеризувати його три основних рівні: загальносоціальний, спеціально-кримінологічний та індивідуально профілактичний. У контексті вивчення загальносоціального запобігання військовим кримінальним правопорушенням в умовах воєнного стану в Україні доведено, що формування патріотизму військовослужбовців ЗСУ й інших військових формувань є неможливим без забезпечення відповідного комплексу державних та соціальних заходів, спрямованих на свідомість і поведінку особистості майбутнього військовослужбовця, метою яких є формування високих громадянських, соціально-психологічних, моральних, фізичних, військово-професійних та вольових якостей, спрямованих на забезпечення як конституційного обов’язку громадян України щодо захисту Вітчизни, так і належного виконання бойових завдань у будь-яких умовах. У межах спеціально-кримінологічного запобігання військовим кримінальним правопорушенням в умовах воєнного стану в Україні обґрунтовано й доведено необхідність на рівні дивізій та бригад створення відділів охорони психічного здоров’я, які мають очолювати психіатри й до складу яких повинні входити офіцери з охорони психічного здоров’я (ліцензовані психологи та/або соціальні працівники із спеціалізованою освітою, які мають щонайменше один рік досвіду роботи у відповідних лікувальних закладах. Встановлено, що основною метою індивідуально-профілактичного запобігання вчиненню військових кримінальних правопорушень в Україні є позитивна корекція особистості військовослужбовця, спрямована на зміну його поведінки від антигромадської до законослухняної. Проведений аналіз судових вироків підтвердив, що кримінальне покарання за вчинення військових кримінальних правопорушень як основний засіб боротьби з відхиленнями в правомірній поведінці військовослужбовців не доводить свою ефективність.

Акцентована увага на процесуальному статусі осіб, які наділені імунітетом під час здійснення кримінального провадження. Розглянуті правові та організаційні особливості участі таких осіб в кримінальному провадженні. Також приділено увагу процесуальному статусу осіб, чиї повноваження регулюються нормами міжнародного права. The monograph examines the issue of the institution of immunity in the criminal process of Ukraine. The immunities of various participants in criminal proceedings are analyzed, namely the immunities of elected officials and officials. As well as immunities of participants in criminal proceedings. Focused attention on the procedural status of persons who are granted immunity during criminal proceedings. The legal and organizational features of the participation of such persons in criminal proceedings are considered. Attention is also paid to the procedural status of persons whose powers are regulated by the norms of international law.
