Анотація
Стаття присвячена актуальному питанню впровадження скандинавської моделі забезпечення публічної
безпеки та порядку під час проведення масових заходів у діяльність органів Національної поліції України
для забезпечення ефективної реалізації конституційного права громадян на мирні зібрання.
У статті встановлено, що право громадян
на мирні зібрання реалізується у сфері публічного
порядку, що зумовлює необхідність наявності ефективного механізму забезпечення цього права. Встановлено поняття публічного порядку.
Основним суб’єктом забезпечення публічного
порядку є Національна поліція України. У статті звертається увага на необхідність імплементації міжнародного досвіду функціонування органів, які забезпечують публічний порядок при проведені масових
заходів, підвищення кваліфікації співробітників Національної поліції України, покращення їх технічного
та матеріального забезпечення. Крім того, необхідним є підвищення рівня психологічної підготовки працівників.
У статті розкриті головні аспекти скандинавської моделі у сфері забезпечення публічного порядку
та безпеки під час проведення масових заходів. Визначено, що підхід скандинавської моделі базується
на: володінні інформацією щодо учасників та організаторів масового заходу; диференціюванні групи
з яких складається натовп та ідентифікації ризиків;
постійному контакті у формі діалогу із організаторами заходу та безпосередньо учасниками зібрання;
сприяння. Проаналізовано нормативну базу щодо
регламентації проведення масових заходів в Україні.
Проаналізовано міжнародний досвід врегулювання
проведення масових заходів. Встановлено брак нормативного регулювання щодо проведення масових
заходів. Обґрунтовано необхідність впровадження
належного регулювання зазначеної сфери законодавством на національному рівні. Встановлено відсутність у чинному законодавстві чіткого закріплення
статусу “Поліції діалогу”. Обґрунтовано необхідність закріплення на рівні закону статусу “Поліції
діалогу”. The article is devoted to the relevant issue
of implementing the Scandinavian model of ensuring public
safety and order during mass events into the activities
of the National Police of Ukraine to ensure the effective
implementation of the constitutional right of citizens to
peaceful assembly.
The article establishes that the right of citizens to
peaceful assembly is realized in the sphere of public
order, which necessitates the existence of an effective
mechanism for ensuring this right. The meaning of public
order has been defined.The main subject of ensuring public
order is the National Police of Ukraine. The article draws
attention to the need to implement the international
experience of the functioning of law enforcement agencies
that ensure public order during mass events, improve
the qualifications of employees of the National Police
of Ukraine, and improve their technical and material
support. In addition, it is necessary to increase the level
of psychological training of employees.
The article reveals the main aspects
of the Scandinavian model in the field of ensuring public
order and security during mass events. It was determined
that the approach of the Scandinavian model is based
on information about the participants and organizers
of the mass event; differentiation of the groups that make
up the crowd and identification of risks; constant dialogue
with the organizers of the event and the participants
of it; assistance. Ukrainian mass meeting legislation has
bees analyzed. The international experience of regulating
mass events was analyzed. A lack of legislation regarding
the holding of mass events has been detected. The need
to implement proper regulation of the specified sphere
