Анотація
У роботі комплексно досліджено адміністративно-правове регулювання антикорупційних заборон та обмежень у діяльності поліцейських в Україні, а також вироблено науково обґрунтовані пропозиції стосовно вдосконалення чинного законодавства у цій сфері. Дослідження конфлікту інтересів як фактору корупції дозволило обґрунтувати, що такий конфлікт є зіткненням (суперечностями) між суспільним благом, забезпечувати яке особа, що приймає управлінське рішення, зобов’язана, і її особистими інтересами та інтересами соціальних груп, до яких вона належить, яке негативно сприймається суспільством і підриває довіру до чесності таких осіб та ефективності органів публічного управління і забезпечення ними публічних інтересів. Зазначено, що виникнення в українському законодавстві поняття «конфлікт інтересів» обумовлено ратифікацією в 2006 році Конвенції ООН проти корупції 2003 р., відповідно до чого український уряд взяв на себе зобов’язання з врегулювання та попередження конфліктів інтересів на публічній службі для запобігання корупції. Визначено модель правового регулювання конфлікту інтересів у публічній діяльності, обрану Україною внаслідок її прагнення до євроінтеграції і побудови правового і демократичного суспільства (врегулювання такого конфлікту в нормах антикорупційного законодавства), виокремлено недоліки та переваги обраної моделі. Проаналізовано підходи до генезису в національному антикорупційному законодавстві поняття конфлікту інтересів як фактору корупції, що створює зіткнення суспільного блага, яке зобов’язане забезпечувати публічна особа, та її приватних інтересів, виокремлено ознаки поняття «конфлікт інтересів» в українському законодавстві (до яких віднесено приватний інтерес, необ’єктивність і упередженість прийняття управлінського рішення та причинний зв’язок між ними). Зазначено, що нормативне врегулювання конфлікту інтересів у публічній діяльності в Україні спрямоване на запобігання корупції та досягається шляхом встановлення щодо спеціальних суб’єктів низки антикорупційних заборон та обмежень, які, з одного боку, зорієнтовані на створення таких умов, за яких у цих суб’єктів не може виникнути можливості скористатися своїми повноваженнями не для публічного блага, а з іншого – обмежують права та свободи вищевказаних суб’єктів. Сформульовано поняття антикорупційних заборон та обмежень в діяльності спеціальних суб’єктів в Україні як системи заходів, спрямованих на обмеження прав та свобод вищевказаних суб’єктів, з метою уникнення конфлікту інтересів у публічній діяльності, запобігання підриву авторитету органів державної влади та місцевого самоврядування, ефективного функціонування органів публічної влади, запобігання підриву довіри до чесності спеціальних суб’єктів і спрямованості їх дій на забезпечення публічних, а не приватних інтересів чи інтересів третіх осіб. Проаналізовано види антикорупційних заборон та обмежень в діяльності спеціальних суб’єктів в Україні та правові норми, якими вони встановлюються. Наголошено на доцільності усунення тавтології правових норм кримінального права та адміністративного права, якими встановлюється заборона використання службових повноважень або службового становища і пов’язаних із цим можливостей з метою одержання неправомірної вигоди, у тому числі використовувати будь-яке державне чи комунальне майно або кошти в приватних інтересах. Досліджено ознаки, які визначають спеціальний статус поліцейського як спеціального суб’єкта, на якого поширюється дія Закону України «Про запобігання корупції» (громадянство, складання присяги поліцейського, проходження служби на відповідних посадах та порядок присвоєння спеціального звання поліції). Відзначено правову невизначеність такої ознаки спеціального статусу поліцейського як проходження служби на відповідних посадах та запропоновано шляхи її усунення. Охарактеризовано види антикорупційних заборон та обмежень в діяльності поліцейських, що встановлюються нормами адміністративного права, а саме щодо: одержання подарунків; сумісництва та суміщення з іншими видами діяльності; спільної роботи близьких осіб; подальшого працевлаштування; доступу та використання інформації. Досліджено генезис введення антикорупційних заборон та обмежень у національну систему антикорупційного законодавства, що дозволило визначити причини, які заважають реалізовувати зазначені заборони та обмеження на практиці в повному обсязі і породжують неоднозначну судову практику. На підставі аналізу поетапного розвитку міжнародного та європейського антикорупційного законодавства, доведено, що утворилися дві моделі щодо визначення подарунків, які отримують спеціальні суб’єкти – подарунки як неправомірна вигода та подарунки як складова конфлікту інтересів і залежно від того, яка з них обирається державою, формується підхід до розроблення законодавства, яким регулюються антикорупційні заборони та обмеження щодо одержання подарунків та встановлення відповідальності за їх порушення (кримінальної чи адміністративної). Вказано, що український законодавець при розробленні антикорупційного законодавства обрав другу модель регламентації обмежень щодо одержання подарунків у діяльності спеціальних суб’єктів – концепцію розуміння подарунка як передумови для конфлікту інтересів і залежно від цього розробив правове регулювання. Досліджено правовий механізм антикорупційних заборон та обмежень щодо отримання подарунків поліцейськими в Україні, визначено його правові проблеми та запропоновано шляхи удосконалення. Ґрунтуючись на нормах міжнародного законодавства, виокремлено ознаки додаткової діяльності, якою не можуть займатися спеціальні суб’єкти. Підкреслено, що при розробленні аналогічних антикорупційних заборон в українському законодавстві міжнародні норми було враховано, але не відтворено повністю і в результаті їх адаптації до національного законодавства утворився своєрідний сплав застарілих «радянських» понять та прийнятого в міжнародній практиці підходу до додаткової діяльності, якою не можуть займатися спеціальні суб’єкти. Досліджено правовий механізм антикорупційних заборон, спрямований на обмеження права спеціальних суб’єктів на зайняття додатковою діяльністю, визначено його недоліки та запропоновано шляхи удосконалення. Підкреслено, що звуження для поліцейських «дозволених» видів діяльності, якими вони можуть займатися додатково, встановлене нормами спеціального закону, в якому визначається їх правовий статус, у порівнянні з іншими спеціальними суб’єктами, на яких розповсюджуються норми антикорупційного законодавства, є невиправданим, не має об’єктивних підстав і раціональних доводів. Зазначено, що введення в національне законодавство спеціальних антикорупційних заборон та обмежень щодо працевлаштування колишніх спеціальних суб’єктів, обумовлено прагненням запобігання можливості використання інформації, що отримана таким суб’єктом за родом своєї попередньої діяльності на користь нового роботодавця, є реалізацією Україною міжнародних антикорупційних норм, спрямованих на запобігання корупції у приватному секторі. Наголошено, що розроблені українським законодавцем норми, в яких встановлюється ця заборона, фактично є декларативними, оскільки не сформовано організаційно-правового підґрунтя для її реалізації. Розроблено ряд пропозицій щодо удосконалення правового механізму антикорупційних заборон та обмежень щодо подальшого працевлаштування спеціальних суб’єктів в Україні. The paper comprehensively studies the administrative and legal regulation of anti-corruption prohibitions and restrictions on the activities of police in Ukraine, as well as develops scientifically grounded proposals for the improvement of existing legislation in this field. The study of conflict of interest as a factor of corruption allowed to substantiate that such a conflict is a collision (contradiction) between the public good, which person is obliged to ensure while making a management decision, his personal interests and the interests of social groups, to which he belongs; which is perceived by society in negative way and undermines сonfidence in the honesty of such persons and the effectiveness of public administration as well as ensuring by them public interests. It is noted that the emergence of the concept of "conflict of interest" in Ukrainian law is due to the ratification in 2006 of the UN Convention against Corruption (2003), according to which the Ukrainian government committed to regulate and prevent conflicts of interest in the public service to prevent corruption. The model of legal regulation of conflict of interests in public activity, chosen by Ukraine due to its desire for European integration and foundation of a legal and democratic society (regulation of such a conflict in anti-corruption legislation) is identified, the shortcomings and advantages of the chosen model are distinguished. The approaches to the genesis in the national anti-corruption legislation of the concept of conflict of interests as a factor of corruption that creates a conflict of public good, which must be provided by a public person, and his private interests are analyzed, as well as the features of "conflict of interest" in Ukrainian legislation (private interest, bias and prejudice of management decisions and the causal link between them). It is noted, that the normative settlement of conflicts of interest in public activities in Ukraine is aimed at the prevention of corruption and is achieved by the establishment of a number of anti-corruption prohibitions and restrictions on special entities, which, on the one hand, are aimed at creating conditions, under which these entities may not have got the possibilities to exercise one's powers not for the public good, but on the other hand, at the restriction of the rights and freedoms of the above-mentioned subjects. The concept of anti-corruption prohibitions and restrictions on the activities of special entities in Ukraine as a system of measures aimed at the restriction of the rights and freedoms of the above mentioned entities, in order to avoid conflicts of interest in public activities, prevent undermining the authority of public authorities and local governments, as well as at the effective functioning of public authorities, prevention of the undermining of confidence in the honesty of special entities and the focus of their actions to ensure public rather than private interests or the interests of third parties is formulated. The types of anti-corruption prohibitions and restrictions on the activities of special entities in Ukraine and the legal regulations, by which they are established, are analyzed. Emphasis is placed on the expediency of eliminating the tautology of legal norms of criminal and administrative law, which prohibit the use of official powers or official position and related opportunities for the purpose of obtaining illegal benefits, including the use of any state or municipal property or funds in private interests. The features that determine the special status of a police officer as a special entity covered by the Law of Ukraine "On Prevention of Corruption" (citizenship, taking the oath of a police officer, serving in certain positions and the procedure for holding a special police rank) have been studied. The legal uncertainty of such a feature of the special status of a police officer as service in the certain positions is noted and ways to eliminate it are suggested. The types of anti-corruption prohibitions and restrictions on the activities of police officers, which are established by the norms of administrative law, are considered, namely regarding: receiving gifts; combination and reconciliation with other activities; joint activities of relatives; further employment; access and use of information. The genesis of the introduction of anti-corruption prohibitions and restrictions in the national system of anti-corruption legislation has been studied, which allowed to identify the reasons that prevent the implementation of these prohibitions and restrictions in practice in full and generate ambiguous case law. On the basis of the analysis of the gradual development of international and European anti-corruption legislation it is proved that two models have been created to determine the gifts received by special entities – gifts as an illegal benefit and gifts as a part of a conflict of interest, and due to their choice an approach to drafting legislation governing anti-corruption prohibitions and restrictions on the receipt of gifts and establishing liability for their violation (criminal or administrative) is formed. It is stated that the Ukrainian legislator in drafting anti-corruption legislation chose the second model of regulation of restrictions on receiving gifts in the activities of special entities – the concept of understanding the gift as a prerequisite for conflict of interest, and accordingly developed legal regulation. The legal mechanism of anti-corruption prohibitions and restrictions on receiving gifts by police officers in Ukraine has been studied, its legal problems have been identified and ways of improvement have been suggested. Due to the norms of international law, the signs of additional activities that special entities cannot be engaged in are singled out. It is emphasized that in the development of similar anti-corruption prohibitions in Ukrainian legislation, international norms were taken into account, but not fully reproduced, and as a result of their adaptation to national legislation a kind of fusion of outdated "Soviet" concepts and internationally accepted approach to additional activities of special subjects was formed. The legal mechanism of anti-corruption prohibitions aimed at the restriction of the right of special entities to engage in additional activities has been studied, its shortcomings have been identified and ways to improve them have been proposed. It is emphasized that the narrowing of the "permitted" activities for police officers, which they may be additionally engaged in, established by the norms of a special law, which determines their legal status, in comparison with other special entities covered by anti-corruption legislation, is unjustified, as it has not objective grounds and rational arguments. It is noted that the introduction into national legislation of special anti-corruption prohibitions and restrictions on employment of former special entities, due to the desire to prevent the possibility of using information obtained by such entity in the course of its previous activities for the benefit of a new employer, is Ukraine's implementation of international anti-corruption norms, aimed at the prevention of corruption in the private sector. It is emphasized that the norms developed by the Ukrainian legislator, which establish this prohibition, are in fact declarative, as no organizational and legal basis for its implementation has been formed. A number of proposals have been developed to improve the legal mechanism of anti-corruption prohibitions and restrictions on further employment of special entities in Ukraine. It is emphasized that anti-corruption restrictions on joint work of relatives in Ukraine are aimed at the limitation of nepotism at work and developed in accordance with international anti-corruption norms; ways to improve the legal mechanism of these restrictions have been suggested. Given the current legal problems in the field of identification, access, circulation, storage of restricted information, for the increase the effectiveness of anti-corruption restrictions on access and use of restricted information, it is argued the feasibility of the development of a list of confidential information that can be accessed by police in the course of its activities, taking into account legal conflicts in the definition of "confidential information", and the adoption of a law that would regulate the types and legal regime of such information. It is proposed to impose an additional prohibition on police officers to participate in gambling, as such an opportunity creates corruption risks in their activities.
