dc.description.abstractСтаттю присвячено дослідженню процесу доказування в провадженні у справах про адміністративні правопорушення. Розмежовано поняття «докази», «джерело доказів» та «доказування». Розглянуто елементи доказування та надано характеристику кожному з його елементів. Збирання доказів охоплює їх пошук, відкриття та процесуальне закріплення. Дослідження доказів передбачає процес отримання від них інформації та осмислення її стосовно конкретної справи з метою встановлення наявності зв’язку з даним правопорушенням. Оцінка відносності доказів складається з виявлення їх зв’язку з предметом доказування по справі. Оцінка допустимості доказів передбачає перевірку їх з точки зору законності. Оцінка доказів з точки зору достовірності полягає у вивченні доказів. The article is devoted to the study of the process of proving in proceedings on administrative offenses. The concepts of «evidence», «source of evidence» and «proving» are distinguished. The elements of proof are considered and the characteristic of each of its elements is given. The collection of evidence covers their search, discovery and procedural consolidation. The examination of evidence involves the process of obtaining information from them and understanding it in relation to a particular case in order to establish a connection with the offense. The evaluation of the relativity of evidence consists of identifying its connection with the subject of evidence in the case. The evaluation of the admissibility of evidence involves examining it from the point of view of legality. The evaluation of evidence in terms of reliability is the study of evidence.uk_UA
