Анотація
the scientific article considers the peculiarities of conducting investigative (search) actions during the
investigation of criminal activity of paramilitary type criminal groups. Scientific, legal and organizational-tactical
bases of investigation of criminal activity of criminal groups of paramilitary type are covered. It is noted that the
specifics of this category of criminal proceedings is explained by the fact that the investigation of the creation of
non-statutory paramilitary or armed groups is carried out in conditions of ambiguity, conspiracy and criminal
hierarchy, complicated by the crime and the subjective composition of its participants significant experience of
criminal activity, their taking measures to disguise their appearance, the use of specific instruments of crime, etc.).
It is determined that the tactics of pre-trial investigation of criminal activity of criminal groups of paramilitary type
are formed in the conditions of rigid counteraction. In view of this, for the high-quality implementation of the tasks
of criminal justice, the tactics of investigation of these crimes should be constantly provided with the latest tools
and methods of investigative (search) actions. The peculiarities of gathering evidence in criminal proceedings
concerning crimes committed by paramilitary criminal groups have been determined, which include: the legal
regime of martial law, state of emergency, anti-terrorist operation; complications with the possibility of carrying
out appropriate procedural actions in connection with limited access to certain areas, premises, with the threat to
life and health of persons involved in such actions. It was stated that the above-mentioned complication may
negatively affect the terms of the pre-trial investigation, as the investigator and prosecutor will not always be able
to carry out appropriate procedural actions in time, which, in turn, may lead to loss of evidence in criminal
proceedings. A number of the most optimal investigative (search) actions have been proposed for a full and
comprehensive investigation of crimes committed by criminal groups of the paramilitary type. У науковій статті розглянуто особливості проведення слідчих (розшукових)
дій під час розслідування злочинної діяльності злочинних угруповань парамілітарного типу.
Висвітлено наукові, правові та організаційно-тактичні засади розслідування злочинної
діяльності злочинних угруповань парамілітарного типу Звернено увагу, що специфіка
зазначеної категорії кримінальних проваджень пояснюється тим, що розслідування провадження
непередбачених законом воєнізованих чи збройних формувань здійснюється у
умовах неочевидності, конспірації та злочинної ієрархії, ускладнених обстановкою вчинення
злочину та суб'єктного складу учасників (вчинення злочинів особами, які мають
значний досвід злочинної діяльності, вжиття ними заходів для маскування зовнішності,
використання специфічних знарядь скоєння злочину тощо). Визначено, що тактика
досудового розслідування злочинної діяльності злочинних угруповань парамілітарного типу
формується за умов жорсткого протидії. Незважаючи на це, для якісної реалізації завдань
кримінального судочинства тактику розслідування зазначених злочинів слід постійно
забезпечувати новітніми засобами та способами проведення слідчих (розшукових) дій.Визначено особливості збирання доказів щодо кримінальних проваджень щодо злочинів,
скоєних злочинними угрупованнями парамілітарного типу, до яких віднесено: правовий режим
військового, надзвичайного стану, проведення антитерористичної операції; ускладнення з
можливістю проведення відповідних процесуальних дій у зв'язку з обмеженим
доступом до окремих ділянок місцевості, приміщень, з наявністю загрози життю та здоров'ю осіб,
що беруть участь у проведенні таких дій. Констатовано, що вищезгадане ускладнення може
негативно впливати на строки досудового розслідування, оскільки слідчий, прокурор не завжди
зможуть своєчасно проводити відповідні процесуальні дії, що, у свою чергу, може
призвести до втрати доказів у кримінальному провадженні. Для повного та всебічного розслідування
злочинів, скоєних злочинним угрупуванням парамілітарного типу, запропоновано низку
найоптимальніших слідчих (розшукових) дій.
