Анотація
У науковій статті досліджено сутність та юридичну
природу правового регулювання протидії злочинам, пов’яза-
ним із торгівлею людьми з метою сексуальної експлуатації.
Проаналізовано основні нормативно-правові акти з питань
протидії вказаним злочинам, визначено проблемні аспекти
та суперечності. З урахуванням закордонного досвіду зро-
блені висновки щодо необхідності вдосконалення правового
регулювання протидії злочинам, пов’язаним із торгівлею
людьми з метою сексуальної експлуатації в Україні. The scientific article explores the essence and legal nature
of the legal regulation of counteraction to crimes related to
trafficking in persons for the purpose of sexual exploitation. The
causes of the crimes of the group in question are examined, as
well as the conditions that contribute to them. The basic regulatory
acts in the field of countering these crimes are analyzed,
problematic aspects and contradictions are identified. The analysis
of the norms of international legal acts in the field of counteractions
crimes related to human trafficking. Issues related
to ensuring the rights of victims of sexual exploitation crimes
are being investigated. Issues of international cooperation in
this area are disclosed. The author, on the basis of the analysis
of regulatory legal acts, the existing points of view of scientists,
expresses his own attitude to this issue and offers a definition
of individual concepts related to countering this type of crime.
The authors argue that the national legislation of Ukraine does
not fully meet international standards for ensuring the rights
of victims of crime and ensuring their safety. The classification
of regulatory acts in the field of combating crime is proposed.
The norms of the criminal and criminal procedure law
of Ukraine are analyzed in detail. The authors, based on the provisions
of the theory of operational-search activity, the views
of modern scientists, as well as the results of the study, reveal in
detail the problematic provisions of national legislation. Based on foreign experience, conclusions are drawn about the need
to improve the legal regulation of combating crimes related to
trafficking in persons for the purpose of sexual exploitation in
Ukraine. The authors’ proposals are based on the results of a survey
and questionnaire of police officers who directly combat
these types of crimes.
