Анотація
У статті обґрунтовано актуальність даної теми в контексті проведення досліджень із питань здійснення публічного адміністрування окремими державними інституціями.
Висвітлено ступінь її наукового вивчення серед науковців. Розкрито поняття, ознаки та зміст правоохоронної функції держави, а також Державної прикордонної служби України.
На прикладі окремих праць українських вчених проведено дослідження поняття правоохоронні органи в контексті аналізу функцій, покладених на Державну прикордонну службу України.
На підставі проведеного аналізу нормативно-правової бази та наявної практики її правозастосування охарактеризовані особливості реалізації правоохоронної функції Державної прикордонної служби у службовій діяльності.
Шляхом аналізу праць дослідників із даної тематики було встановлено, що в різних державах на різних історичних етапах розвитку охоронних правових потреб їх кількість, зміст, організація державної влади має певну специфіку, що відображається і на правоохоронних функціях держави, які змінюються у просторі і в часі. Тому, з одного боку, правоохоронні функції держави об’єктивні за своєю природою, з іншого – на них впливає характер державної влади та умови її реалізації.
На підставі чого зроблено висновок, що нові загрози національній безпеці України, які з’явилися на східній та південній частинах державного кордону, в умовах сьогодення суттєво впливають на реалізацію правоохоронної функції держави в цілому та окремо Державної прикордонної служби, викликають необхідність у пошуку нових форм та методів її забезпечення.
А саме розробки і здійснення конкретних заходів нормативно-правового та організаційного характеру, які передбачають удосконалення внутрішньовідомчої нормативної бази, адміністративного впорядкування, реформування і вдосконалення системи Державної прикордонної служби України.
The article substantiates the relevance of this topic in the context of research on the implementation of public administration by individual state institutions. The degree of its scientific study among scientists is highlighted.
The concept, signs and content of the law enforcement function of the state, as well as the State Border Guard Service of Ukraine, are disclosed. On the example of individual works of Ukrainian scientists, a study of the concept of law enforcement agencies in the context of the analysis of the functions assigned to the State Border Guard Service of Ukraine was carried out.
Based on the analysis of the regulatory framework and the existing practice of its law enforcement, the features of the implementation of the law enforcement function of the State Border Service in official activities are characterized. By analyzing the works of researchers on this topic, it was found that in different states at different historical stages of development of protective legal needs, their number, content, organization of state power has a certain specificity, which undoubtedly affects the law enforcement functions of the state, which change in space and time.
Therefore, on the one hand, the law enforcement functions of the state are objective in nature, on the other hand, they are influenced by the nature of state power and the conditions for its implementation.
Based on this, it was concluded that the new threats to the national security of Ukraine, which appeared on the eastern and southern parts of the state border, in today’s conditions significantly affect the implementation of the law enforcement function of the state as a whole and separately on the functions of the State Border Guard Service.
This, in turn, necessitates the search for new forms and methods of its provision. In particular, the development and implementation of specific measures of a regulatory and organizational nature, which provide for the improvement of the intradepartmental regulatory framework, streamlining of administrative activities, reforming and improving the system of the State Border Guard Service of Ukraine.
