Анотація
В роботі розглядаються проблемні питання щодо використання методу ситуаційного моделювання в криміналістичних експертизах та шляхи їх подолання. Підвищення ефективності експертно-криміналістичного забезпечення правоохоронної діяльності можливе як в ході безперервного розвитку сучасних науково-технічних засобів і методів та підвищення рівня професійної підготовки співробітників, що використовують у своїй роботі ці засоби, так і в результаті впровадження сучасних положень теорії судової експертизи і криміналістики в практику. Одним з важливих напрямків у цій діяльності є реалізація концепції ситуаційного підходу у правозастосовчій діяльності, зокрема ситуаційне моделювання в експертно-криміналістичній діяльності. Але нажаль реалізація ситуаційного підходу в експертно-криміналістичній діяльності на теперішній час не є досить ефективною, в зв’язку з наявністю проблем методологічного та кваліфікаційного характеру. В работе рассматриваются проблемные вопросы использования метода ситуационного моделирования в криминалистических экспертизах и пути их решения. Повышение эффективности экспертно-криминалистического обеспечения правоохранительной деятельности возможно как в ходе непрерывного развития современных научно-технических средств и методов и повышение уровня профессиональной подготовки сотрудников, использующих в своей работе эти средства, так и в результате внедрения современных положений теории судебной экспертизы и криминалистики в практику. Одним из важных направлений в этой деятельности является реализация концепции ситуационного подхода в правоприменительной деятельности, в частности ситуационное моделирование в экспертно-криминалистической деятельности. Но, к сожалению, реализация ситуационного подхода в экспертно-криминалистической деятельности в настоящее время не является достаточно эффективной, в связи с наличием проблем методологического и квалификационного характера. This paper considers issues regarding the use of situational modeling method in forensic and ways to overcome them. Improved Forensic Support of Law Enforcement as possible in the continuous development of modern scientific and technical means and methods and improving the professional training of staff in its work to these products, and as a result of the theory of modern forensics and criminology in practice. One of the important directions of this activity is to implement the concept of situational approach in law enforcement, including situational modeling in Forensic activities. But unfortunately the implementation situational approach in Forensic activity at present is not very effective, due to the presence of methodological problems and the nature of the qualification. Known forensic examination conducted under conditions of certain situations of expert knowledge which helps to solve specific research objectives. Expert situation in criminology seen as a system of factors that are the basis for the nomination of the most probable versions expert, choosing methods of testing, planning research.In other words, the expert situation – a collection prevailing at a particular expert investigation of the circumstances on which the program is determined by the expert of experts to solve problems. The best means of knowledge and the development of solutions to expert (like all forensic) situations are situational modeling – a method of research situations, which includes building a model of the real situation and with it a different kind of thought experiments (forecasting trends of its development and (or); «play»;on her alleged situation management solutions to select optimal). As a result of situational modeling expert research facilities with an event, you can set: properties and condition used in the commission of criminal offenses material objects; properties and conditions of the factors of the situation event of criminal offenses (spatial, temporal, situational); course and mechanism of individual stages and processes of criminal offenses and their interactions with each other and various objects. The successful application of situational modeling in Forensic activities necessary to solve several problems. First, employees need acquaintance Forensic institutions with the theoretical basis of situation modeling: simulation types (material, mental, logical-mathematical, cybernetic, information computer, modeling the offender, the mechanism of crime, expert research, etc.); components of process modeling (entity modeling tasks solved subject, object and method of modeling, etc.), situational modeling stages (problem, build a model situation, abstracting from minor to study the circumstances, situation diagnosis, accounting dynamic factors, identifying a number of possible alternative solutions to manage the situation, «play»; solutions on the model and the choice of optimal), and more. Experts should be familiar with the writings of scholars engaged in the study of forensic situations, situational (including experts) modeling. Secondly, it is necessary to achieve the maximum «saturation»; of employees Forensic institutions relevant information reference and auxiliary nature (modern information retrieval systems, automated reference files, collections, etc.) to create the most reliable information models. Great expectations in information security situational modeling in Forensic activities nowadays rely on an integrated system of forensic registration, which develops through integrated application of information and communication technologies. In the third, for effective situational modeling experts and forensic specialists who participate as experts in the investigation, forensic skills necessary to develop a mindset that help by analyzing the set of information fields discovered and investigated at the scene, during searches and other investigation, submit to the investigators model of criminal and criminal events. In the fourth, situational modeling in Forensic activity involves a situational assessments. In situational examination established range of different attributes of the objects that make up a complete picture of events throughout the study; established mechanism of this event, which in turn requires different in nature forensic examinations. This highlights the integral nature of the situational assessment.
