dc.description.abstractУ статті розглянуто питання предмету злочину, який вчинено у сфері страхування. Зроблено висновок про те, що предмет злочину, який вчинено у сфері страхування є необов’язковий для всіх злочинів, але обов’язковий для предметних складів злочинів елемент, яким можуть бути нерухоме майно (нерухомість); рухоме майно: грошові кошти, цінні папери, банківські метали та інше рухоме майно, що має визначену вартість, а також майнові права на цю рухомість та майнові вигоди; послуги, інформація, результати інтелектуальної, творчої діяльності та інші об’єкти права інтелектуальної власності, які мають матеріальний вираз, з властивостями яких та з вказівкою на які закон про кримінальну відповідальність пов’язує наявність складу злочину в діяннях особи. В статье рассмотрены вопросы предмета преступления, который совершен в сфере страхования. Сделан вывод о том, что предмет преступления, который совершен в сфере страхования является необязательный для всех реступлений, но обязательный для предметных составов преступлений элемент, которым могут быть недвижимое имущество (недвижимость); движимое имущество: денежные средства, ценные бумаги, банковские металлы и другое движимое имущество, имеющее определенную стоимость, а также имущественные права на эту недвижимость и имущественные выгоды; услуги, информация, результаты интеллектуальной деятельности и иные объекты интеллектуальной собственности, которые имеют материальное выражение, со свойствами которых и с указанием на которые закон об уголовной ответственности связывает наличие состава преступления в действиях лица. The article deals with the subject of the crime committed in the field of insurance. The specifics of the subject of criminal offenses in the field of insurance are connected with the way and circumstances of their com-mission, the person of the offender and other elements of the mechanism of the crime, reflected in the forensic characteristics of their individual types. Quantitative and qualitative features of the subject of criminal offenses in the field of insurance affect the choice of the method of its preparation, commission and concealment. At the same time, the subject of the crime indicates certain features of the person of the offender, possible traces of it. It is these properties of the subject matter of fundamental importance for the methodology for investigating criminal offenses in the field of insurance. The subject of criminal offenses in the field of insurance is property (tangible assets, cash) belonging to the right of ownership to a natural or legal person. In fact, certain types of property are forms of existence of value, differ-ing in the intended purpose [6, p. 8]. General features of property as the subject of criminal offenses in the field of insurance are contained in civil law. Consequently, it was concluded that the object of an offense committed in the field of insurance is not necessary for all crimes, but an element essential to the substantive crimes component, which may be real estate (real estate); movable property: money, securities, bank metals and other movable property having a certain value, as well as property rights to this movement and property benefits; services, information, results of intellectual, creative activity and other objects of intellectual property rights, which have a material expression, with the properties of which and indicating which law on criminal liability links the presence of the crime in the acts of the person.uk_UA
