dc.description.abstractАвторами зазначається, що судова практика у таких справах формується дуже швидко, але вважаємо, що вкрай необхідно, щоб в умовах воєнного стану суспільство знало та розуміло, що вчинення кримінального злочину проти основ національної безпеки України та проти миру, безпеки людства та міжнародного правопорядку неодмінно призводить до покарання.Критерії розмежування складу кримінальних правопорушень за ст. 111 та 111-1 КК України слід визнати особливості їх складу, обставини вчинення кримінальних правопорушень, а також суб’єкта та суб’єктивну сто- рону. Важливо визначити мету вчинення і за рахунок якої держави вчиняється кримінальне правопорушення. The authors note that judicial practice in such cases is formed very quickly, but we believe that it is extremely necessary that in the conditions of martial law society knows and understands that the commission of a criminal offense against the foundations of national security of Ukraine and against peace, security of humanity and the international legal order inevitably leads to to punishment. Criteria for distinguishing the composition of criminal offenses under Art. 111 and 111-1 of the Criminal Code of Ukraine should recognize the peculiarities of their composition, the circumstances of the commission of criminal offenses, as well as the subject and the subjective party. It is important to determine the purpose of the commission and at the expense of which state the criminal offense is committed.uk_UA
