dc.description.abstractРозглянуто питання роз витку правових механізмів за безпечення і захист у праві свобод людини і громадянина в су часних умовах глобалізації. Відмічено, що в сучасному світі за умов глобаль ної інтеграції та глобалізації права відбувається вдосконалення демократичних інститутів держав світу, уніфікація предмету консти туційного регулювання та формування глобального права, що регулює весь спектр суспільних відносин. Досліджено феномен становлення міжнародного конституційного права як результат впровадження консти туційних положень у науку міжнародного права. Здійснено аналіз сучасних нормативних джерел міжнародного консти туційного права та підходів до визначення новітньої концепції глобального конституціоналізму з метою розуміння перспектив розвитку сис теми реалізації прав людини в умовах глобалізації. The article deals with the question of development of legal mechanisms of providing and protection of rights and freedoms of man and citizen in the modern globalization settings. The author asserts that in the modern world conditions of global integration and globalization of law one can observe an improvement of democratic institutes of the states of the world, unification of the object of the constitutional adjusting and a forming of global law that regulates all spectrum of public relations. The author queries whether forming of the field of international constitutional law is related to legitimizing of equal codified document – Global Constitution and ask a question what would normatively objectivize international constitutional law and could define its role and place in the system of both international and domestic (national) law. Also the article deals with the analysis of the modern normative foundations of international constitutional law and the approaches of determination of the newest concept of global constitutionalism in order to understand the prospects of development of the system of human rights realization in conditions of globalization. The core idea of global constitutionalism is based on constitutionalist concern to launch political legitimacy for global norms for international community.uk_UA
