| dc.description.abstract | Стаття присвячена аналізу обману як способу скоєння злочину, в якій за допомогою порівняльно-правового, істо- ричного, систематичного та граматичного методів були розглянуті ці поняття. Проаналізувавши обман як спосіб вчинення психічного насильства, можна зробити загальний висновок, що обман здійснюється поза волею потерпілого і ставить останнього у вузькі рамки під час вибору порядку дій. За формальними ознаками обман відповідає психічному насильству. Обман – умисне викривлення або приховування істини з метою ввести в оману особу, у віданні якої зна- ходиться право на майно або права на інші блага, і таким чином домогтися добровільної передачі цих прав, а також повідомлення з цією метою завідомо неправдивої інформа- ції. Істина – це точне відображення дійсності в думках і сві- домості людини. Створення шахраєм у потерпілої особи хибних уявлень про явища дійсності, про властивості пред- метів і осіб – це і є спотворення істини. This article analyzes deception as a means of committing a crime, which by means of comparative legal, historical, grammatical and systematic methods were reviewed these concepts. The method of committing a crime is an obligatory feature of the crime not only in cases where it is explicitly stated in the law, but also when it clearly follows from it. For example, it is impossible to commit fraud, causing property damage by deception or abuse of trust, knowingly false notification of a crime or knowingly false testimony not using fraud as a method of committing a crime. The method of committing a crime serves as a mandatory feature of the relevant components of the crime is an analysis and characteristic actions that form the objective side of these crimes. Characteristically, a socially dangerous act in the specified warehouses cannot be objectively executed without the proper method of its execution. Thus, beatings and torture without physical violence, threats of murder, forced sexual intercourse cannot be inflicted – without mental violence, fraud, knowingly false reporting of a crime – without deception, abuse of office – without abuse of trust, etc. Thus, in the above cases, the method of committing a crime, although not directly and not specified in the law, but clearly derives from him in his interpretation, and therefore is a mandatory feature of the relevant specific components of the crimes. Analyzing deception as a way of committing psychological violence, the overall conclusion that the fraud carried out against the will of the victim and puts the latter in the narrow confines in choosing to proceed. Formally responsible fraud mental violence. A deceit is a deliberate distortion or concealment of the truth in order to mislead the person in charge of the right to property or the right to other goods, and thus to obtain the voluntary transfer of these rights, as well as to report a false information to this end. Truth is a true reflection of reality in the thoughts and human consciousness. Creating a fraudsters in the victim’s misconceptions about the phenomena of reality, about the properties of objects and individuals – this is the distortion of the truth. | uk_UA |
