Анотація
Метою статті є аналіз та характеристика між-
народних механізмів захисту прав дітей на прикладі
європейських інституцій. Проаналізовані міжнародні
нормативно-правові документи, які спрямовані на
забезпечення прав дітей та які ратифіковані держав-
ними органами нашої країни для подальшого прак-
тичного застосування у правовій площині захисту
основних інтересів дітей. Автором визначені основні
права дитини. Доведено, що Конвенція ООН про права
дитини є основним систематизованим нормативним
актом, що містить основні права дитини.
Визначені основні міжнародні правові механізми
захисту прав неповнолітніх, шляхом деталізації
організаційно-правових інститутів, серед яких про-
відне місце займає: Комітет ООН по правах дитини,
Дитячий фонд ООН (ЮНІСЕФ), Всесвітня організа-
ція охорони здоров’я (ВООЗ), Організація Об’єднаних
Націй з питань науки, освіти і культури (ЮНЕСКО).
Встановлено, одним з важливих способів захисту
прав дітей є судовий захист. Наголошено на тому,
що саме Європейський Суд з прав людини є тим між-
народним механізмом, що вирішує справи по суті, де
одним з суб’єктів чиї права були порушені виступа-
ють діти або їх представники.
Акцентовано увагу на тому, що ефективність
норм міжнародного права залежить від правових
механізмів, які здатні забезпечити їх дотримання,
якщо політика держави та її правова система забез-
печує, ратифікує та втілює в життя громадян
міжнародні норми права, то міжнародні стандарти
захисту прав дитини будуть дієвими при вирішенні
конкретної справи на її благо.
В стаття розмежовується та роз’яснюються
міжнародне нормативно-правового забезпечення
захисту прав дітей, дослідити наявність міжнарод-
них механізмів спрямованих на захист прав непо-
внолітніх, встановити роль судового захисту прав
дітей на прикладі Європейського Суду з прав людини.
В статті також запропонований механізму
вдосконалення захисту прав дітей, з урахуванням
вивчення міжнародного досвіду. The purpose of the article is to analyze and characterize
international mechanisms for the protection of children's
rights on the example of European institutions.
International legal documents aimed at ensuring
children's rights are analyzed and which are ratified
by the state bodies of our country for further practical
application in the legal sphere of protection of the basic
interests of children. The author defined the basic rights
of the child. It has been proven that the UN Convention on
the Rights of the Child is the main systematized regulatory
act containing the basic rights of the child.
The main international legal mechanisms for
the protection of the rights of minors have been
determined, by detailing the organizational and legal
institutions, among which the leading place is occupied
by: Committee on the Rights of the Child, Children's
Fund (UNICEF), World Health Organization (WHO), United
Nations Scientific, Educational and Cultural Organization
(UNESCO).
It has been established that one of the important
ways of protecting children's rights is judicial protection.
It was emphasized that the European Court of Human
Rights is the international mechanism that decides cases
on the merits where children or their representatives are
one of the subjects whose rights have been violated.
Attention is focused on the fact that the effectiveness
of the norms of international law depends on the legal
mechanisms that are able to ensure their compliance, if
the policy of the state and its legal system ensure, ratify
and implement international norms of law in the lives
of citizens, then international standards for the protection
of the child's rights will be effective when a specific case is
resolved for the child's benefit.
In the article розмежовується and explained
international normatively-legal providing of protection
of rights for children, to investigate the presence
of international mechanisms of the rights for minor sent
to defence, set the role of judicial protection of rights
for children on the example of Європейського Court on
human rights.
In the article also offered to the mechanism
of perfection of protection of rights for children, taking
into account the study of international experience.
