dc.description.abstractУ статті розглядаються питання правового регулювання відносин щодо надання державної допомоги у зв’язку з бідністю, здійснюється аналіз поняття «бідність» та його співвідношення з такими категоріями як «малозабезпеченість» та «злиденність», досліджуються критерії оцінки бідності та аналізується практика їх застосування у правозастосовчій діяльності. В статье рассматриваются вопросы правового регулирования отношений по предоставлению государственной помощи в связи с бедностью, осуществляется анализ понятия «бедность» и его соотношение с такими категориями как «малообеспеченность» и «нищета», исследуются критерии оценки бедности и анализируется практика их применения в правоприменительной деятельности. State support for low-income persons occupies an important place in the system of social protection of any country. In the article the questions of the legal regulation of relations on state aid due to poverty, the analysis of the concept of «poverty» and its relationship with such categories as «low income» and «poverty», examines criteria for assessing poverty and analyzed their practical application in law activity. In providing state aid to indigent (poor) persons in Ukraine remains a number of issues, both economic and legal nature. Legal regulation of public relations in this area cannot be considered perfect, and practice requires sound scientific recommendations to bring the legislation into conformity with social standards, its systematization and unification. Representatives of economic theory there are several degrees of level of living: prosperity, normal level, poverty and misery. Poverty is defined as consumption of benefits on the level of functionality as the lower border of the reproduction of labor power. Squalor involves the intake minimum allowable biological criteria of the set of goods and services, which only allows you to maintain the vitality of the person. The poor are individuals whose income exceeds the cost of the minimum consumer basket, but less than the average in the country, However, among economists there is no common evaluation criteria of poverty, which make it possible to distinguish between low income, poverty and misery. The relative socio-economic dimensions of poverty has a direct impact on legal regulation. In world practice, poverty has long been recognized as a social risk, which includes the right to social protection and the poverty line is set as a criterion for providing social assistance to needy persons. But national law as a social risk provides such person’s state of being inadequate, which again was not properly legislative consolidation. Legislation in the field of social security uses the concept of «needy family» or «needy person». The existing legal framework the definition of poverty is flawed and not consistent with other evaluation rules in the system of social protection. The use of two parallel mechanisms in one area, the use of double standards of social security destroys the effectiveness of the whole system of legal measures for social protection in relation to poverty. Is it appropriate fastening in the current legislation of poverty as a social risk, as well as harmonization of its core indicators as criteria for the granting of social assistance.uk_UA
