dc.description.abstractConceptual pre-conditions of forming of criminal-executive principles of functioning of the State criminal-executive service of Ukraine are exposed in the article. The conducted analysis of conceptual pre-conditions of forming of criminal-executive principles of functioning of SCES of Ukraine in part of realization of basic measures in concrete direction of reformation of the criminal-executive system of Ukraine gave possibility: to define the achievements of those or other political forces responsible for realization of concrete direction of public policy in the field of implementation of criminal punishments (Main administration of implementation of punishments of MIA of Ukraine, SDUES, SPS of Ukraine, Ministry of Justice of Ukraine); to find out a degree and chronology of realization of corresponding measures of reformation of corresponding segment of the criminal-executive system; to take into account the state of realization in the process of development of the next program documents (conceptions, strategies and others like that). In the article the circumstance is confirmed that to the near-term tasks of modernisation of criminal-executive legislation as pre-conditions of functioning of SCES of Ukraine belonged first of all decision of political and theoretical basis of decision of practical tasks of organization implementation and serving of punishment, the place of organs and establishments of implementation of punishments in the system of mechanism of the state, optimal combination of criminal punishment with the task of correction and resocialization of convicts, forming in society of humane treatment toward convicts, and of penitentiary staff - focus on internationally recognized approaches to the implementation of punishments. It is proved that the constituents of development of the criminal-executive system of Ukraine since the moment of receipt of independence to passing the Law of Ukraine "About Government criminal-executive service of Ukraine" became: entering of Ukraine into Council of Europe (1995); acceptance of Constitution of Ukraine (1996); formation of State Department of Ukraine for Execution of Sentences (1998) and removal it from MIA of Ukraine (1999); acceptance of the new CC of Ukraine (2001); acceptance of CEC of Ukraine (2003); acceptance of a row of branch laws "About a preliminary conclusion" (1993), "About state protection of court employees and law enforcement authorities" (1993), "About a general structure and quantity of the criminal-executive system of Ukraine" (2000) and others).uk_UA
