dc.description.abstractThe article defines the essence of the preparatory proceedings as an independent stage of the criminal process. The judicial situation is defined and characterized as an independent category. The typical unfavorable situations that arise during the criminal prosecution in the preparatory proceedings are highlighted. The system of tasks that arise before the prosecutor in each of the above situations is formulated. The organizational and tactical algorithms of the prosecutor's actions in case the court returns the indictment are outlined. The typical mechanisms of the prosecutor's actions in case of refusal by the court to approve a plea agreement are described. It is emphasized that the organizational and tactical model of further criminal prosecution is determined by the result of resolving court situations that arise during the preparatory proceedings. У статті визначено сутність підготовчого провадження як самостійної стадії кримінального процесу. Визначено та охарактеризовано судову ситуацію як самостійну категорію. Виділено типові несприятливі ситуації, що виникають під час здійснення кримінального переслідування у підготовчому провадженні. Сформульовано систему завдань, що постають перед прокурором у кожній із наведених ситуацій. Визначено організаційно-тактичні алгоритми дій прокурора у разі повернення судом обвинувального акту. Охарактеризовано типові механізми дій прокурора у разі відмови судом у затвердженні угоди про визнання винності Зазначено, що організаційно-тактична модель подальшого провадження кримінального переслідування обумовлено результатом вирішення судових ситуацій, що виникають під час підготовчого провадження.uk_UA
