dc.description.abstractДослідження та аналіз досвіду зарубіжних країн свідчать, що в Україні доцільно створити відповідний Закон із метою вдосконалення законодавчих підстав для кримінального переслідування підозрюваних у скоєнні злочину, що передбачений ст. 332-1 чинного Кримінального кодексу України, забезпечення захисту прав держави, зниження рівня контрабанди та нелегальних перевезень, що здійснюються через тимчасово окуповані або тимчасово непідконтрольні Україні території внаслідок військової або збройної агресії інших країн. The article is devoted to the investigation of the criminal legislation of foreign countries on violation of the order of entrance and exit out of the temporarily occupied territory. The criminal law of foreign countries establishes the responsibility for the illegal crossing of the state border. In the view of the objective side such actions are similar to violations of the order of entrance and exit out of the temporarily occupied territory. The legislation of the following countries as Azerbaijan Republic, Bulgaria, Armenia, Georgia, Estonian Republic, Spain, Kazakhstan, Kyrgyz Republic, Latvia, Lithuania, Republic of Belarus, Tajikistan, Turkish Republic, Turkmenistan, Uzbekistan, Federal Republic of Germany, which directly provides for a specific criminal law or similar to it by the construction of the objective side – the intersection of the state border has been studied. The compositions of crimes for illegal crossing of the state border, their qualifying features, the responsibility for which are provided by the Criminal Codes of foreign countries, are analyzed. The status of foreigners and stateless persons has been determined. It is established that the composition of crimes for responsibility for violation of the order of entrance and exit out of the temporarily occupied territory (crossing the state border) in the criminal legislation of foreign countries is contained in the sections on responsibility for crimes against the state. In the Criminal Code of Ukraine this type of crime is referred to the Section XIV «Crimes in the Field of State Secrets, State Borders, Enlistment and Mobilization». Taking into account the positive experience of foreign countries, proposals were made to improve the current legislation of Ukraine in the specified field: the creation of an appropriate Law in order to improve the legal grounds for criminal prosecution of suspected persons in committing a crime under Art. 332-1 of the current Criminal Code of Ukraine, ensuring the protection of the rights of the state, reducing the level of smuggling and illegal transportation, which are carried out through temporarily occupied or temporarily uncontrolled by Ukraine territories due to military or armed aggression of other countries.
