dc.description.abstractУ статті розкрито методологічні засади функціонування Державної криміналь- но-виконавчої служби України. Установлено, що вироблення методологічних засад функціонування Державної кримінально-виконавчої служби України у сфері виконання покарань на науковій основі сприяє комплексному та системному її дослідженню, а також створює переду- мови конструктивного розв’язання таких завдань, як визначення стану дослідження функціонування Державної кримінально-виконавчої служби України, розкриття методологічних засад дослідження її функціонування тощо. У статті підтверджено той факт, що в процесі дослідження функціонування Дер- жавної кримінально-виконавчої служби України однією з умов її підвищення та засто- сування на практиці норм кримінально-виконавчого законодавства є обов’язкове про- гнозування наслідків такої діяльності й прийняття відповідних рішень по суті. При цьому серед комплексу методів, що використовуються в кримінально-виконавчих дослідженнях функціонування Державної кримінально-виконавчої служби України, особливе місце посідає підвищення її якості у сфері виконання покарань. Доведено, що методологія цього наукового пошуку не тільки й не стільки створює ефективні та оптимальні умови для пізнання змісту об’єкта і предмета дослідження, а і є необхідним елементом удосконалення функціонування Державної криміналь- но-виконавчої служби України на сучасному етапі її реформування та розвитку. Надано авторське визначення методології дослідження функціонування Державної кримінально-виконавчої служби України як певної системи наукового знання про методи, прийоми й засоби, які становлять комплекс апробованих на практиці най- більш раціональних шляхів функціонування Державної кримінально-виконавчої служби України у сфері виконання покарань. The article describes the methodological foundations of the functioning of the State Criminal Enforcement Service of Ukraine. The author has established that elaboration of methodological bases of functioning of the State Penal and Execution Service of Ukraine in the sphere of punishment execution on a scientific basis promotes to carry out complex and systematic research of it, and also creates preconditions for constructive solution of such tasks as: determination of the state of study of functioning of the State Penal Enforcement Service Ukraine, disclosure of methodological bases of research of its functioning, etc. In this article it is confirmed that in the process of investigation of the functioning of the State Internal Affairs Service of Ukraine, one of the conditions for its enhancement and the application of the rules of penal law in practice is the obligatory forecasting of the consequences of such activity and making the relevant decisions on the merits. At the same time, among the complex of methods used in criminal-law investigations of the functioning of the State Internal Affairs Service of Ukraine, special attention is given to improving its quality in the sphere of punishment execution. It is proved that the methodology of this scientific search not only creates not only effective and optimum conditions for understanding the content of the object and object of research, but is also a necessary element for improving the functioning of the State Criminal Enforcement Service of Ukraine at the present stage of its reform and development. The author defines the methodology of researching the functioning of the State Penal Enforcement Service of Ukraine as a certain system of scientific knowledge about the methods, techniques and tools that make up the complex of the most rational ways of functioning of the State Penal Enforcement Service of Ukraine in the sphere of execution of sentences.uk_UA
