dc.description.abstractУ статті досліджено поняття громадського контролю у сфері місцевого самоврядування та форми його реалізації. Зроблено висновок, що громадський контроль у сфері місцевого самоврядування реалізується територіальною громадою через такі форми безпосередньої демократії, як місцеві референдуми, місцеві ініціативи, громадські слухання, загальні збори громадян. Унаслідок аналізу місцевих практик застосування зазначених форм громадського контролю в Україні, таких як місцеві референдуми, громадські слухання, загальні збори громадян за місцем проживання та місцеві ініціативи, зроблено висновок про неефективне використання ресурсу цих форм як форм громадського контролю у сфері місцевого самоврядування в Україні та наголошується, що їхня ефективність прямо залежна від деталізації порядку їх проведення в нормативно-правових актах. В статье исследовано понятие общественного контроля в сфере местного самоуправления и формы его реализации. Сделан вывод, что общественный контроль в сфере местного самоуправления реализуется территориальной громадой через такие формы непосредственной демократии, как местные референдумы, местные инициативы, общественные слушания, общие собрания граждан. В результате анализа местных практик применения таких форм общественного контроля в Украине, как местные референдумы, общественные слушания, общие собрания граждан по месту жительства и местные инициативы, сделан вывод о неэффективном использовании ресурса этих форм как форм общественного контроля в сфере местного самоуправления в Украине и отмечается, что их эффективность находится в прямой зависимости от детализации порядка их проведения в нормативно-правовых актах. The article examines the public control concept in the feld of local self-government and forms of its implementation. lt is concluded that public control in the sphere of local self-government is realized by the territorial community through such forms of direct democracy as referendum, local initiatives, public hearings, meetings, get-togethers, campaigns, demonstrations, appeals, general meetings of citizens. As a result of statistical data analysis of such using a form of local democracy as local referendums, the conclusion is drawn about the ineffective use of this form's resources as form of public control over the activities of bodies and oficials of local self-government in Ukraine. An analysis of local practices for the use of such forms of public control in Ukraine as public hearings, general meetings of citizens at the place of residence and local initiatives give grounds to assert that their effectiveness is directly depended on the detail of the procedure for their implementation in the charters of local communities. The article emphasizes that in order to create an effective mechanism of public control in the feld of local self-government, a lot of efforts are required both to the community and public authorities of Ukraine. There is a signifcant negative impact on the implementation by the territorial community of the control over the activities of local authorities and oficials in Ukraine due to the lack of proper regulatory and legal support for this process. And, therefore, there is an urgent need for the adoption of the Law of Ukraine "Оn Local Referendums" and the Law of Ukraine "Оn General Meetings (Conferences) of Members of the Territorial Community at the Рlace of Residence", as well as the regulation of the implementation of the right to local initiatives and public hearings in the statutes of the territorial communities. rial community, local self-government, public control, public hearings, general assembly of citizens, local initiatives, localdum, territorial community.uk_UA
