dc.description.abstractМетою дослідження є висвітлення інтерпретації загального концепту прав людини у діяльності Європейського суду з прав людини. Визначено такі чинники необхідності пізнання практики Європейського суду з прав людини (у контексті сприйняття прав людини), як зобов’язання України дотримуватись вимог Ради Європи; розуміння національним законодавством практики Європейського суду з прав людини джерелом права в Україні; перетворення практики Європейського суду з прав людини на основу для розуміння змісту принципу верховенства права. Відзначено, що увага вчених переважно зосереджується на інтерпретації Європейським судом з прав людини конкретних прав, закріплених у Конвенції про захист прав людини та основоположних свобод, а не на сприйнятті загального концепту прав людини. The aim of the study is to elucidate the general concept of human rights interpretation in the European Court of Human Rights’ activities. The following factors as the need to know the European Court of Human Rights practice (in the context of human rights perception) are identified: Ukraine must comply with the requirements of the Council of Europe; the European Court of Human Rights’ practice is recognized by national law as a source of law in Ukraine; and, thirdly, the European Court of Human Rights’ practice is the basis for understanding of the rule of law essence. It is noted that the scholars’ attention is focused mainly on the specific rights’ interpretation, enshrined in the Convention for the Protection of Human Rights and Fundamental Freedoms, rather than on the perception of the general concept of human rights, by the European Court of Human Rights.uk_UA
