Анотація
Стаття присвячена з’ясуванню питання забезпе-
чення людських прав в особливих умовах окремими
міжнародними інституціями. Метою дослідження
є висвітлення загальних положень забезпечення люд-
ських прав людини в умовах війни за результатами
узагальнення практики Європейського суду з прав
людини.
Відзначається, що Європейський суд з прав людини
є одним з ефективних органів, діяльність якого сут-
тєво впливає на національну систему права та стан
реалізації людських прав у державах-учасницях Кон-
венції про захист прав людини та основоположних
свобод.
Вказується, що в практиці Європейського суду
з прав людини було сформульовано доктрину субси-
діарної ролі Суду, відповідно до якої він не розгляда-
ється як суд четвертої інстанції (він не є апеляцій-
ною інстанцією щодо рішення національних судів, не
переглядає рішення останніх).
Аналізуються питання юрисдикції, наводяться
положення з рішень Європейського суду з прав людини,
вказується на визнання цим Судом відповідально-
сті Росії за порушення людських прав на території
Автономної Республіки Крим та міста Севастополь
з лютого 2014 року.
Вказується на чотири міждержавні заяви щодо
Росії, які перебувають на розгляді Європейського суду
з прав людини: щодо Автономної Республіки Крим,
щодо окупованих територій Донецької та Луганських
областей, щодо вбивств політичних опонентів,
щодо захоплення українських моряків і суден.
Наголошується на можливості використання
чотиримісячного строку звернення до Європейського
суду з прав людини щодо порушень Росією положень
Конвенції про захист прав людини та основоположних
свобод, вчинених у серпні та вересні 2022 року.
Резюмується, що в умовах війни Європейський суд
з прав людини залишається інституцією, що виступає
гарантом реалізації положень Конвенції про захист
прав людини та основоположних свобод. У практиці
цього Суду є рішення, у яких розглядаються як між-
державні справи, так і індивідуальні. Одним з важли-
вих питань, яке з’ясовує Суд, є питання юрисдикції:
яка держава здійснює ефективний контроль на від-
повідній території. Однією з обставин, що вплинули
на розгляд справ проти Росії, є припинення її участі
у Конвенції про захист прав людини та основополож-
них свобод у вересні 2022 року. The article is devoted to clarifying the issue of ensuring
human rights by individual international institutions in
special conditions. The purpose of the study is to cover
general provisions of ensuring human rights in wartime
based on the European Court of Human Rights practice
generalization results.
It is noted that the European Court of Human
Rights is one of the effective institutions the activity
of which has a significant impact on the national legal
system and the state of human rights implementation
of the Convention for the Protection of Human Rights
and Fundamental Freedoms member states.
It is indicated that the doctrine of the subsidiary
role of the Court was formulated in the European Court
of Human Rights practice, according to which it is not
considered as a court of the fourth instance (it is not
an appellate institution regarding the decisions of national
courts, and it does not review the decisions of the latter).
Jurisdiction issues are analyzed, provisions
of the decisions of the European Court of Human Rights
are cited, and the recognition by this Court of Russia’s
responsibility for human rights violations on the territory
of the Autonomous Republic of Crimea and the city
of Sevastopol since February 2014 is indicated.
It is noted that four interstate statements against
Russia that are under consideration by the European
Court of Human Rights, namely regarding the Autonomous
Republic of Crimea, regarding the occupied territories
of Donetsk and Luhansk regions, regarding
the killing of political opponents, and regarding the seizure
of the Ukrainian sailors and ships.
The possibility of using the four-month period
of appeal to the European Court of Human Rights regarding
Russia’s violations of the provisions of the Convention for
the Protection of Human Rights and Fundamental Freedoms
committed in August and September 2022 is emphasized. It is summarized that in the conditions of war
the European Court of Human Rights remains an institution
that acts as the guarantor of the Convention on
the Protection of Human Rights and Fundamental Freedoms
provisions implementation. In the practice of this Court,
there are decisions in which both interstate and individual
cases are considered. One of the important issues that
the Court clarifies is the question of jurisdiction: which
state exercises effective control over the relevant territory.
One of the circumstances that influenced the consideration
of cases against Russia is the termination of its participation
in the Convention on the Protection of Human Rights
and Fundamental Freedoms in September 2022.
