Анотація
Авторами стверджується, що застосування Національною поліцією України спеціальних засобів на сучасному етапі мають особливості, пов’язані зі змінами в законодавстві, які розширили її повноваження для виконання покладених на неї завдань з участі у забезпеченні та здійсненні заходів правового режиму воєнного стану в ході відсічі збройної агресії проти України, у виконанні завдань територіальної оборони тощо. Водночас, зміни у законодавстві характеризуються недостатньою визначеністю нормативно-правової бази, яка потребує уточнення термінів і понять, тлумачення та роз’яснення запроваджених новел, переосмислення, насамперед, оновлення та розширення переліку та підстав спеціальних засобів у залежності від їх ролі, змісту та спрямованості застосування з урахування потреб та викликів сьогодення, а також забезпечення одноманітного праворозуміння та правозастосування. The authors claim that the use of special means by the National Police of Ukraine at the current stage has features related to changes in the legislation, which expanded its powers to fulfill the tasks assigned to it to participate in ensuring and implementing measures of the legal regime of martial law in the course of repelling armed aggression against Ukraine, in the performance of territorial defense tasks, etc. At the same time, the changes in the legislation are characterized by an insufficient definition of the legal framework, which requires clarification of terms and concepts, interpretation and clarification of introduced novelties, rethinking, first of all, updating and expanding the list and grounds of special means depending on their role, content and direction of application taking into account the needs and challenges of today, as well as ensuring uniform legal understanding and law enforcement.
