Анотація
Запропоновано класифікацію різновидів мотивів і мети
умисних убивств. Доведено, що під час досудового
розслідування будь-яких кримінальних проваджень потрібно
обов’язково визначати мотиви та мету злочину, незалежно від
того, є вони кваліфікуючою ознакою складу злочину чи ні,
злочин учинено навмисно чи з необережності. Констатовано,
що мета й мотиви завжди ґрунтуються на потягах,
потребах, інтересах, бажаннях та корелюють між собою. In this article the author proposed the classification of the
deliberate murder’s motives and purposes variety. It was
emphasized that the motive helps to determine the fact with which
the person connects the crime committing, how he explains his own
behavior and which purposes does he follow. The deliberate
murder’s purpose analyze during the pretrial investigation of the
deliberate murder promotes to: understand the meaning of the
crime’s subject behavior, 2) establish certain consistent patterns and
the mechanism of the crime’s subject’s behavior operation;
3) determine the level of the crime’s subject behavior impact on the
socially-legal relations. That’s why the pretrial investigation subjects
have to know, how to determine the deliberate crime’s purpose and
to indicate it precisely in the procedural documents which have the
criminal-law meaning.
It was noted that the purpose and motive are based always on
the appetencies, demands, interests and wishes content of which is
defined by the antisocial personality’s direction. The motive and the
purpose are all interrelated, interdependent and correlative. All of
them generate the wish to achieve the wishful result by means of the
determined ways. The purpose and the motive only in their unity may
give the full imagination about the criminal’s behavior direction about
true character of his illegal behavior. Criminal activity is also
purposeful, that’s why it is necessarily to determine the crime’s
motives and purposes during the pretrial investigation of any crimes
independently whether the motives and purposes are as the
classification feature of the crime’s composition, or the crime is
committed deliberately or by inadvertency.
