ПРОАКТИВНА ДІЯЛЬНІСТЬ ПОЛІЦІЇ ЯК ОСНОВА СКАНДИНАВСЬКОЇ МОДЕЛІ ОХОРОНИ ГРОМАДСЬКОГО ПОРЯДКУ ПІД ЧАС ПРОВЕДЕННЯ МАСОВИХ ЗАХОДІВ

Анотація
Стаття присвячена актуальному питанню орга-
нізації, проведення масових заходів та діяльності
Національної поліції України щодо забезпечення належ-
них умов для реалізації громадянами права на мирні
зібрання, закріпленого Конституцією України. Автором
наголошено, що більшість основоположних прав грома-
дян, закріплених в Основному Законі держави, реалізу-
ються у сфері публічного порядку, що вимагає від дер-
жави створення належних умов для реалізації цих прав.
Центральним органом виконавчої влади, на який
покладено забезпечення реалізації права на мирні
зібрання, є Національна поліція України. Для вико-
нання цього завдання поліції необхідно постійно вдо-
сконалювати професійну діяльність, спираючись на
міжнародний досвід у зазначеній сфері.
У статті розкрито особливості та переваги
Скандинавської моделі охорони громадського порядку
та безпеки під час масових заходів.
Автором акцентовано увагу на проактивній діяль-
ності поліції, яка спрямована на упередження правопо-
рушень та співпрацю з громадськістю, що є виражен-
ням саме Скандинавської моделі охорони публічного
порядку під час проведення масового заходу.
Встановлено, що однією з проблем реалізації Скан-
динавської моделі є відсутність спеціального закону
про проведення масових заходів. Одним з ключових
елементів нової концепції охорони громадського
порядку є запровадження «поліції діалогу». Чотири
стовпи цього підходу: по-перше, отримати якомога
більше знань про склад будь-якого натовпу, по-друге,
навчитися розрізняти різні частини натовпу
та визначати, де є ризики, по-третє, вести постій-
ний діалог та спілкування з організаторами заходів
та членами натовпу і, нарешті, сприяння. Для реа-
лізації основного принципу «поліції діалогу», який
передбачає зв’язок між поліцією та організаторами
масових заходів, важливо встановити чіткий поря-
док повідомлення про такі події. Обґрунтована необ-
хідність прийняття спеціального закону про масові
заходи в Україні, а також визначення порядку пові-
домлення про масові заходи, що повинне подаватися
до органів Національної поліції. The article is devoted to the topical issue of organizing,
holding mass events and the activities of the National
Police of Ukraine to ensure safe conditions for citizens to
realization their right to peaceful assembly, enshrined in
the Constitution of Ukraine. The author noted that most
of the fundamental rights of citizens enshrined in the Basic
Law of the state are implemented in the sphere of public
order, which requires the state to provide appropriate
conditions for the implementation of these rights.
The legal basis for holding mass events in Ukraine is
analyzed. It is established that the lack of a special law on
holding mass events is one of the problems of realization
of the Scandinavian model. The National Police of Ukraine
is the central body of executive power entrusted with
ensuring the realization of the right to peaceful assembly.
To fulfill this task, the police must constantly improve
their professional activities, based on international
experience in this area.
The article reveals the features and advantages
of the Scandinavian model of public order and security
during public events.
The attention is focused on the proactive activity
of the police, which is aimed at preventing offenses
and cooperation with the public, which is an expression
of the Scandinavian model of public order protection
during a mass event.
One of the problems with the implementation
of the Scandinavian model is the lack of a special law on
mass events. One of the key elements of the new concept
of public order protection is the introduction of “dialogue
police”. There are four points of view of this approach – first,
get as much knowledge as possible about the composition
of any crowd, second, learn to distinguish between
different parts of the crowd and identify the possible risks,
third, constant dialogue and communication with event
organizers and crowd members and finally, assistance. To
implement the basic principle of the “dialogue policing”,
which provides communication between the police and the organizers of mass events, it is important to
establish a clear procedure for notification of such events.
The necessity of adopting a special law on public events
in Ukraine, as well as determining the procedure for
notification of public events that must be submitted to
the national police, has been substantiated.
