Анотація
У статті висвітлюються ключові аспекти проведення конституційної реформи в
Україні, що слугуватимуть забезпеченню її дієвості та результативності. Виділено
об’єктивні причини конституційних реформ, серед котрих як внутрішньополітичні, так і
зовнішні. Визначено основні ознаки конституційної реформи: поетапність проведення;
системність конституційних перетворень; динаміка конституційних правовідносин;
формування конституційної правосвідомості; створення функціонального механізму
забезпечення і захисту конституційного правопорядку та конституційної законності;
інтеграція конституційного законодавства у систему сучасного конституціоналізму;
здійснення реформ у певних часових межах (історичних рамках); поширення
конституційних перетворень на певну територію. Окреслено цілі конституційно–
правової реформи: формальне їх визначення; визначення передбачуваних можливостей
даної реформи, прогнозування її результатів; забезпечення принципу системності у
визначенні цілей та постановці конкретних завдань; усунення кон’юнктурних цілей.
Указано, що конституційна реформа є стрижнем і методологічною основою правової
реформи. Означено, що конституція як об’єкт реформування є багатоплановим і
багатофункціональним феноменом, всі основні аспекти її сутності, особливості характеру
і засобів її впливу на державу й суспільство мають прямий вияв у змісті та порядку її
перетворення. In the article highlights the key aspects of constitutional reform in Ukraine, which will
help ensure its effectiveness and impact. It was found essential characteristics of the
constitution as the object of reform that should combine the following qualities: stability, which
promotes factor of welfare, reliability, sustainability and implementation and dynamism,
because responds to changes that are constantly occurring in society. Objective reasons for
constitutional reforms are highlighted, among them both internal political and external ones.
The basic signs of constitutional reform are defined: step–by–step conduct; systemic
constitutional changes; dynamics of constitutional legal relations; formation of constitutional
justice; creation of a functional mechanism for the provision and protection of constitutional
law and constitutional law; integration of constitutional legislation into the system of modern constitutionalism; implementation of reforms at certain time limits (historical framework); the
spread of constitutional reforms to a certain territory. It is highlighted the objectives of
constitutional and legal reform: the formal definition of them; definition of the prospective
possibilities of this reform; forecasting its results; ensuring the principle of systemicity in
defining goals and setting specific tasks; elimination of conjunctural goals of constitutional and
legal reform.
It is indicated that constitutional reform is the basis and methodological basis of legal
reform. Summarized constitutional reform, which involves the reform of the political system is
(must) at the same time and in its essence and state–legal reform. It is stated that constitutional
reform, as a political in its nature, always relates to the relations of government, it is aimed at
their improvement and connected with the reform of the political system of society. It is
understood that the constitution as an object of reform is a multifaceted and multifunctional
phenomenon; therefore, all the main aspects of its essence, especially the nature and means of
its influence on the state and society, have a direct manifestation in the change and the order of
its transformation.
