Анотація
У статті в теоретико-правовому аспекті висвітлено децентралізований напрям щодо ор-
ганізації публічної влади як запоруки розвитку правової держави в Україні. Охарактеризовано
розуміння та визначено внутрішню структуру процесу децентралізації публічної влади. Зосе-
реджено увагу на новітніх підходах проведення процесу децентралізації публічної влади відпо-
відно до вимог сьогодення, що призведе до її ефективності та продуктивної дієвості у задо-
воленні потреб громадян країни. Проаналізовано механізми збереження балансу публічної влади
у процесі її децентралізації в унітарній державі. Визначено та розкрито об’єкти, передумови
і спеціальні принципи децентралізації публічної влади. Означено систему гарантій ефективної
діяльності елементів організації публічної влади як за вертикаллю, так і горизонталлю, серед
яких є система «стримувань і противаг», нормативні, організаційні, фінансові. Обґрунтовано,
що забезпечення децентралізації публічної влади в Україні призведе до своєрідного механізму
продуктивного упорядкування суспільних відносин, для задоволення інтересів населення країни. In the article in the theoretical and legal aspects highlighted decentralized direction for the
organization of public authority as a guarantee of the development of law in Ukraine. Characterized
understanding and defi ned internal structure of the process of decentralization of public power.
Concentrate the emphasis on innovative approaches of realization decentralization of public power with
nowadays requirements that will make productive effi ciency and effectiveness in meeting the needs of
citizens. Analyzed the saving mechanisms to maintain the balance of public authorities in the process of
decentralization in a unitary state. Determined and disclosed objects, preconditions (social, economic,
political) and special principles of decentralization of public power (subsidiarity, specialization,
cooperation, «ultra vires»). Determined the content of the socialized aspect of decentralization of public
power, which is the harmonization of social life, prevention nascence in society social contradictions
and confl icts, the reasons of which, in particular, are inconsistencies in the economic and social
development of the various regions of the state. Based on the experience of nation-building in countries
with developed democratic fret shown that one of the basic conditions for the existence and functioning
of such countries is a guarantees system of effective operation of organization public power elements
both vertically and horizontally, including a system of “checks and balances”, regulatory, institutional,
fi nancial. Proved that providing decentralization of public power in Ukraine will lead to a kind of
mechanism for organizing productive social relations that would meet modern trends of national
resistance state, the international standards in this area and as a whole to meet the needs and interests
of its own population.
