Анотація
У статті обґрунтовано актуальність обраної теми, проведено загальний аналіз досліджень із питань визначення понять «державна територія» і «державний кордон», правових основ їх захисту спеціальним правоохоронним органом – Державною прикордонною службою України (далі – ДПС України).
На основі аналізу позицій провідних науковців із конституційного, міжнародного та адміністративного права, які комплексно досліджували питання державного кордону і державної території, було розкрито їхнє наукове поняття і зміст.
Авторами запропоновано уточнення поняття «державний кордон» та «адміністративно-регуляторна діяльність ДПС України».
Під час проведення дослідження поняття «державний кордон» розглянуто його основні функції та проаналізовано види міжнародних кордонів. Розглянуто проблемні теоретичні питання змісту наукових категорій «державний кордон» і «державна територія» у контексті забезпечення їх охорони та захисту підрозділами ДПС України.
Досліджено питання появи в адміністративному законодавстві та практичній діяльності ДПС України таких нових категорій, як «лінія розмежування», «тимчасово окупована територія», «контрольована територія», надана характеристика їх юридичного змісту.
З адміністративно-правового погляду проаналізовано зміст законодавства, яким встановлюються прикордонні режимні правила і визначаються адміністративно-правові основи охорони державного кордону України, а також лінії розмежування із тимчасово окупованими територіями.
Розглянуто повноваження ДПС України у врегулюванні прикордонних відносин і забезпеченні адміністративної процедури перетинання громадянами лінії розмежування.
Сформульовано висновки і пропозиції, які мають сприяти як подальшому дослідженню цих проблем, так і вдосконаленню механізму правового регулювання державного кордону, а також підвищенню ефективності його охорони. The article substantiates the relevance of the chosen topic. A general analysis of research on defining the concepts of state territory and state border and the legal basis for their protection by a special law enforcement agency of the State Border Guard Service of Ukraine (hereinafter – the State Border Service of Ukraine).
Based on the analysis of the positions of leading scholars on constitutional, international and administrative law, who comprehensively studied the issues of the state border and state territory, their scientific concept and content were revealed. The authors propose to clarify the concept of «state border» and «administrative and regulatory activities of the State Tax Service of Ukraine».
In the process of studying the concepts of the state border, its main functions were considered and the types of international borders were analyzed. Problematic theoretical issues of the content of the scientific categories «state border» and «state territory» in the context of ensuring their protection and protection by units of the State Tax Service of Ukraine are considered.
The issue of appearance of such new categories in the administrative legislation and practical activity of the State Tax Service of Ukraine – as «demarcation line», «temporarily occupied territory», «controlled territory» and the characteristic of their legal content is investigated. From the administrative and legal point of view, the content of the legislation is analyzed, which establishes the border regime rules and determines the administrative and legal basis for the protection of the state border of Ukraine and the demarcation line with the temporarily occupied territories.
The powers of the State Tax Service of Ukraine in settling border relations and ensuring the administrative procedure for citizens to cross the demarcation line are considered.
Conclusions and proposals have been formulated, which should contribute to further research of these problems, as well as to the improvement of the mechanism of legal regulation of the state border, as well as to the increase of the efficiency of its protection.
