Анотація
Розглядаються структурні елементи адміністративно–правового статусу суб’єктів
страхування цивільно–правової відповідальності власників наземних транспортних засобів
в Україні. Обґрунтовано доводиться, що адміністративно–правовим статусом
Нацкомфінпослуг України доцільно визначити його положення у ієрархії органів
виконавчої влади, яке створює умови для забезпечення спроможності Комісії своїми
односторонніми діями (актами) породжувати, змінювати або припиняти
адміністративно–правові правовідносини у сфері регулювання ринків фінансових
послуг. До структури адміністративно–правового статусу Нацкомфінпослуг України
доцільно віднести такі елементи: 1) мета, завдання, функції; 2) компетенція; 3)організація
діяльності; 4) юридична відповідальність службовців Нацкомфінпослуг України. The question of the content and structure of the administrative and legal status of a
certain state body is crucial for solving the problems of improving the organization of its
activities, adjusting the place in the system of state authorities, and therefore increasing the
effectiveness of its activities.
The structural elements of the administrative and legal status of subjects of civil liability
insurance of owners of land vehicles in Ukraine are considered. It is established that the legal
status of an official includes, first of all, constitutional (general) rights and correspondent duties
that determine the content of legal personality and are inseparable from an individual. An
official may act in three main qualities: a) as a carrier of constitutional rights and obligations; b)
as a subject of power functions; c) as an individual subject.
In determining the elements of the administrative and legal status of the National
Financial and Economic Commission of Ukraine, several circumstances should be taken into
account. First of all, the fact that the National Financial Services Commission of Ukraine is a
state body and, in accordance with the current legislation, it operates with a lawful purpose
through the fulfillment of certain tasks, realizing specific functions. As a state body, the
National Financial Services Commission of Ukraine has a certain organizational structure in the
form of an organizational structure – in fact, the National Financial Services Commission of
Ukraine, its structural divisions, territorial bodies. Secondly, the tasks and functions of the
National Financial and Economic Commission of Ukraine are implemented through the
activities of its employees as officials who acquire powers of the respective competence of the
National Financial Services Commission of Ukraine. For non–fulfillment or improper
performance of the authority, employees of the National Financial Services Commission of
Ukraine bear legal responsibility.
It is reasonable to prove that the administrative and legal status of the National Financial
Services Commission of Ukraine is expedient to determine its position in the hierarchy of
executive authorities, which creates conditions for the Commission to create, amend or
terminate administrative and legal legal relations in the sphere of regulation of financial services markets by their unilateral acts (acts). In the structure of the administrative status of the
National Financial Services Commission of Ukraine it is expedient to include the following
elements: 1) goals, tasks, functions; 2) competence; 3) organization of activity; 4) legal liability of
employees of the National Financial Services Commission of Ukraine.
