Анотація
In determining the administrative and legal status of subjects of administrative and legal relations in the sphere of cyber security in Ukraine a number of legal acts related to the national (cyber) security of Ukraine were analyzed. The article also provides information on the organization of the system of subjects of cyber security in Ukraine in the table, based on the content of the Law of Ukraine "On basic principles of cyber security of Ukraine" and the Strategy of cyber security. First of all, the article analyzed the work of scientists who dealt with such a legal category as "subjects of administrative law". A comparative legal analysis of the definitions of "legal entity" and "legal entity" was carried out. Against the background of the work performed, we have provided our own interpretation of the "subjects of administrative law", by which we understand the actual participants in the administrative relationship, which are vested with subjective rights and legal responsibilities, which can be classified depending on the presence of public authorities powers. Thus, we can speak of the existence of two groups of subjects of administrative law - these are natural persons, which may include citizens, foreigners and stateless persons; legal, which include state and local authorities, enterprises, institutions, organizations, including public ones. On this basis, the article argues that cybersecurity entities include public authorities and local governments, state and non-governmental enterprises, institutions and organizations, citizens and other persons empowered to carry out security activities of vital importance. interests of the individual, society and the state in the cybernetic sphere. As a result of the study of this issue, it was suggested that under the administrative and legal status of the subjects of administrative and legal relations in the field of cyber security in Ukraine to understand the regulated at the legislative level activities of specially authorized by the state bodies empowered to apply administrative and legal measures to ensure the cyber security security of Ukraine. The conclusions are that the main burden on the implementation of the state policy in the field of cybersecurity lies with the executive authorities and law enforcement agencies, whose purpose is to implement the administrative state administration. These bodies, using their own administrative and legal status, enter into legal relations with other subjects of state-administrative activity, bodies of local self-government, public organizations and citizens. Во время рассмотрения административно-правового статуса субъектов административно-правовых отношений в сфере обеспечения кибернетической безопасности в Украине было проанализировано ряд нормативно-правовых актов, касающихся национальной (кибернетической) безопасности Украины. В статье был проведен сравнительно-правовой анализ дефиниций «субъект правовых отношений» и «субъект права». На фоне проведенной работы было предоставлено собственное толкование «субъектов административного права». Під час розгляду адміністративно-правового статусу суб'єктів адміністративно-правових відносин у сфері забезпечення кібернетичної безпеки в Україні було проаналізовано низку нормативно-правових актів щодо національної (кібернетичної) безпеки України. У статті було проведено порівняльно-правовий аналіз дефініцій «суб'єкт правових відносин» та «суб'єкт права». З огляду на проведеної роботи було надано власне тлумачення «суб'єктів адміністративного права».
