The content of the conceptual apparatus of the study is considered: "criminal offense". Types of criminal offenses are analyzed. Varieties of criminal offenses of servicemen are formed, relying on statistical data. The latency of war crimes, the causes and actions to prevent them are considered. The national prevention of crime among servicemen in Ukraine through economic, political, ideological and organizational measures aimed at economic development, raising the living standards of citizens, thus solving the problem of eliminating crime.

The structure of the AFU, the categories of military personnel and persons equated to them shows that crime in the Armed Forces is a complex set of of unlawful actions, which is heterogeneous and unequal in nature, level and structure in relation to different troops and categories, and has relevant determinants that generate such crime.
- ДокументЗАСТОСУВАННЯ ПОЛІГРАФА У КРИМІНАЛЬНОМУ ПРОВАДЖЕННІ: ОСОБЛИВОСТІ ТА ПРОБЛЕМНІ ПИТАННЯ(Одеса: ОДУВС; Херсонський факультет., 2021) Дмитренко, Наталя Андріївна; Dmytrenko, NataliaСтаттю присвячено дослідженню особливостей та проблемних питань застосу- вання поліграфу у кримінальному провадженні. Визначено, що в кримінальному провадженні на законодавчому рівні немає закрі- плення поняття «поліграф». Експертиза із застосуванням поліграфа – це різновид судових психологічних експертиз, на які поширюється дія Закону України «Про судову експертизу». Подібні експертизи проводяться з метою формування доказової бази в судовому процесі чи під час досудового слідства. Встановлено, що можливе використання поліграфа в ході оперативно-розшукової діяльності, спрямованої на виявлення злочинів і осіб, що їх підготовлюють і здійсню- ють та в ході проведення слідчих дій у кримінальному та судовому процесі у вигляді судових психофізіологічних експертиз на поліграфі. Проведення судових психофізіологічних експертиз на поліграфі в кримінальних справах українським законодавством не заборонено і допускається, процедура про- ведення опосередковано регламентується Кримінальним процесуальним кодексом України та Законом України «Про судову експертизу», проте наразі відсутня стан- дартизація діяльності спеціаліста поліграфолога. Це призводить до того, що суди не завжди приймають висновки поліграфічного дослідження за докази у справі. Проаналізовано Постанову ККС Верховного Суду від 3 червня 2020 року по справі № 686/4267/15-к та визначено, що призначення експертизи із застосуванням полі- графа повинно відбуватися у суворій відповідності до процесуальних кодексів для того, щоб експертиза стала допустимим доказом у справі і була врахована під час судового розгляду справи. Визначено підстави застосування поліграфа під час кримінального провадження. До них належать: постанова слідчого; рішення суду по особистій ініціативі або по кло- потанню сторін/потерпілого; звернення сторони захисту в кримінальному процесі. Проаналізовано необхідність підвищення ефективності поліграфічної експертизи, адже ця обставина впливає на правове забезпечення застосування поліграфа в кримі- нальному провадженні. Адже поки висновок експертизи, проведеної з використан- ням поліграфічного обладнання, не може бути використаний в якості однозначного доказу винності або невинності підозрюваного або обвинуваченого. The article is devoted to the study of the peculiarities and problematic issues of the use of the polygraph in criminal proceedings. It is determined that in criminal proceedings at the legislative level there is no consolidation of the concept of “polygraph”. Polygraph examination is a type of forensic psychological examination, which is covered by the Law of Ukraine “On Forensic Examination”. Such examinations are conducted in order to form the evidence base in the trial or during the pre-trial investigation. It is established that it is possible to use a polygraph in the course of operational and investigative activities aimed at identifying crimes and persons who prepare and commit them and in the course of investigative actions in criminal and judicial proceedings in the form of forensic psychophysiological examinations on the polygraph. Forensic psychophysiological examinations on a polygraph in criminal cases are not prohibited by Ukrainian law and are allowed, the procedure is indirectly regulated by the Criminal Procedure Code of Ukraine and the Law of Ukraine “On Forensic Examination”, but currently there is no standardization of polygraph specialists. This leads to the fact that the courts do not always accept the conclusions of the printing examination as evidence in the case. The Decision of the KKC of the Supreme Court of June 3, 2020 in case № 686/4267/15-k was analyzed and it was determined that the appointment of a polygraph examination should be in strict accordance with procedural codes in order for the examination to be admissible evidence in the case and taken into account during the trial. The grounds for the use of a polygraph during criminal proceedings have been determined. These include: the decision of the investigator; court decision on personal initiative or at the request of the parties / victim; appeal of the defense in criminal proceedings. The necessity of increasing the efficiency of polygraphic examination is analyzed, as this circumstance influences the legal support of polygraph application in criminal proceedings. After all, while the conclusion of the examination carried out with the use of printing equipment cannot be used as unequivocal evidence of guilt or innocence of the suspect or accused.
