- ДокументДотримання конституційних засад у процесі прийняття державного бюджету(Одеса: ОДУВС; Херсонський факультет., 2021) Кузьменко, Юлія Василівна; Kuzmenko, Yuliia; Шабага, Тетяна Миколаївна; Shabaha, TetianaУ статті представлено наукові результати аналізу питання дотримання конституційних засад у процесі прийняття державного бюджету України, визначено, що він є головним фінансовим документом країни, який встановлює системний розподіл державних фінансових ресурсів. Врахування норм Конституції України (ст. 3, 5, 7, 55, 85, 92, 95, 96, 97, 116, 126, 142, 143) у процесі розгляду, прийняття та виконання закону про Державний бюджет – необхідний чинник суверенітету нашої держави. Осо-блива правова природа бюджетного процесу проявляється й у тому, що: по-перше, обов’язкова процедура щорічного прийняття закону повинна здійснюється відповідно до специфічної процесуальної форми та юридичного механізму (гл. 7 Бюджетного кодексу України); по-друге, має чітко окреслений проміжок своєї правоздатності (починається 1 січня кожного року і закінчується 31 грудня того ж року); по-третє, без цього закону усі фінансові операції із державним та місцевим бюджетами здійсню-вати неможливо; по-четверте, свою чинність повинен набрати до 1 січня, інакше це призведе до економічних втрат у країни через зупинку механізм взаємодії державного фінансування усіх галузей народного господарства. Автор підкреслює, що бюджет, як головний фінансовий документ нашої держави, є кошторисом доходної та видатко-вою стороною фінансової діяльності держави, що затверджений законодавчою гіл-кою влади у вигляді закону і відображає напрями реалізації економічної, соціальної, екологічної, боргової, оборонної, міжнародної політики країни. У статті зосереджено увагу на тому, що за своєю економіко-правовою сутністю бюджет – це план формування та використання фінансових ресурсів для забезпе-чення завдань і функцій, що покладено на органи державної влади та органи міс-цевого самоврядування, і виступають невід’ємною частиною закону про Державний бюджет країни. Охарактеризовано негативні наслідки порушення бюджетного процесу прописаного і визначеного в Конституції України та Бюджетному кодексі. The article presents the scientific results of the analysis of the issues of compliance with constitutional principles in the process of adopting the state budget of Ukraine, it is determined that it is the main financial document of the country, which establishes a systemic distribution of state financial resources. Accounting for the norms of the Constitution of Ukraine (Articles 3, 5, 7, 55, 85, 92, 95, 96, 97, 116, 126, 142, 143) in the process of consideration, adoption and implementation of the law on the State Budget is a necessary factor of our state's sovereignty. The special legal nature of the budget process is manifested in the fact that: first, the mandatory procedure for the annual adoption of the law must be carried out in accordance with a specific procedural form and legal mechanism (Chapter 7 of the Budget Code of Ukraine); secondly, it has a clearly defined period of its legal capacity (starting on January 1 of each year and ending on December 31 of the same year); thirdly, it is impossible to carry out all operations with the state and local budgets without this law; fourth, it must enter into force by January 1, otherwise it will lead to economic losses in the country due to the suspension of the mechanism of interaction of public funding of all sectors of the economy. The author emphasizes that the budget, as the main financial document of our state, is an estimate of the revenue and expenditure side of the state's financial activities, approved by the legislature in the form of law and reflects the implementation of economic, social, environmental, debt, defence and international policy. The article focuses on the fact that in its economic and legal essence the budget is a plan for the formation and use of financial resources to ensure tasks and functions, entrusted to public authorities and local governments, and it is an integral part of the law on the state budget. There are prescribed and defined the negative consequences of the violation of the budget process in the Constitution of Ukraine and the Budget Code.
- ДокументПоширення торгівлі людьми за умов збройного конфлікту на сході України(Одеса: ОДУВС; Херсонський факультет., 2021) Кузьменко, Юлія Василівна; Kuzmenko, Yuliia; Думанський, Роман Вікторович; Dumanskyi, RomanАктуальність статті полягає в тому, що нестабільна соціально-економічна ситуація, низький рівень правової культури населення, насильство проти жінок і дітей, коруп-ція, політичний дисбаланс, конфлікт на сході України, безпринципність злочинців, нарощення попиту на дешеву робочу силу або неформальну працю, зростання потреб у сфері трансплантації органів створюють сприятливі умови для розвитку тіньового бізнесу у сфері торгівлі людьми. Мета статті полягає у дослідженні поширення торгівлі людьми за умов Операції об’єднаних сил, що проходить на сході України, визначення причин поширення цього явища серед населення. У статті виявлено фактори, причини й умови, що сприяють поширенню торгівлі «живим товаром» за умов Операції об’єднаних сил, що проходить на сході України; проаналізовано нормативно-правові акти у сфері запобігання поширенню торгівлі людьми; надано пропозиції щодо посилення юридичної відповідальності за торгівлю людьми. Збройний конфлікт дає можливості не лише для протизаконного переміщення зброї, боєприпасів, наркотиків, але й людей. Також підкреслено, що поширення торгівлі людьми через непідконтрольний схід України є глобальною світовою проблемою, що потребує негайного вирішення. Збройний конфлікт породжує грубі порушення прав і свобод людини, зокрема сприяє й торгівлі людьми. Українська влада повинна вберегти своїх громадян від цих злочинів і встановити таке покарання за цей злочин, яке буде суттєвим і справедливим. На законодавчому рівні необхідно прийняти зміни, що значно посилять юридичну відповідальність статей Кримінального кодексу щодо торгівлі «живим товаром» (секс-торгівлі, рабства, безоплатної трудової експлуатації), а також окремо вважаємо слід внести статтю в цей кодекс із суттєвими санкціями щодо «чорної трансплантології» та «трансплантаційного туризму». Цілком логічно, що потребують змін і нормативно-правові акти щодо протидії та запобіганню торгівлі людьми уповноваженими органами Національної поліції, у яких би віддзеркалювалися особливості проведення таких заходів на тимчасово окупованій території. The relevance of the article lies in the fact that the unstable socio-economic situation, low level of legal culture of the population, the violence against women and children, corruption, political imbalance, conflict in eastern Ukraine, the unscrupulousness of criminals, increasing demand for cheap labor or informal work and growing needs in the field of organ transplantation – all these create favorable conditions for the development of shadow business in the field of human trafficking. The purpose of the article is to study the spread of human trafficking in the conditions of the joint forces operation, which takes place in the East of Ukraine and to determine the reasons for the spread of this phenomenon among the population. The article identifies the factors, reasons and conditions that contribute to the spread of trade in “live goods” in the conditions of the operation of the combined forces, which takes place in the East of Ukraine; there are analyzed the regulatory legal acts in the field of preventing the spread of human trafficking; and also made proposals to strengthen legal responsibility for human trafficking. Armed conflict allows not only for the illegal movement of weapons, ammunition, drugs, but also people. There was also emphasized that the spread of human trafficking through the uncontrolled East of Ukraine is a world global problem that requires an immediate solution. It was also noted that the armed conflict gives rise to gross violations of human rights and freedoms and contributes to human trafficking. The Ukrainian government must protect its citizens from these crimes and establish a punishment for this crime that will be equitable. At the legislative level, it is necessary to adopt changes, which will significantly strengthen the legal responsibility of the articles of the Criminal Code regarding the sale of “live goods” (sex trade, slavery, free labor exploitation), and we also consider that the article should be introduced into this code with significant sanctions regarding “black transplantation” and “transplant tourism”. It is quite logical that it will require the changes and regulatory legal acts regarding the counteraction and prevention of human trafficking by authorized bodies of the National Police, which would reflect the specifics of such events in the temporarily occupied territory.
